Prosecutions are not brought under the provisions of the Human Rights Act. A person may bring a civil claim under the Act or rely on Convention rights in any legal proceedings.

Lord Taylor of Warwick – 2016 Parliamentary Question to the Department for Culture, Media and Sport

To ask Her Majesty’s Government what steps they plan to take to support small and medium-sized enterprises in the light of the number of cyber attacks against them in 2015.

The Government’s National Cyber Security Programme (NCSP) aims to tackle cyber crime and make the UK the safest place in the world to do business in the world. This includes the Cyber Essentials Scheme to protect businesses against common cyber threats and the cyber streetwise campaign which offers simple cyber security advice to small businesses and consumers. In addition to the £860 million investment under the NCSP between 2011-2016, in November 2015 the Chancellor announced a new five year £1.9 billion investment in cyber security to make the UK one of the best protected countries in cyber space.

Tom Elliott – 2016 Parliamentary Question to the Scotland Office

To ask the Secretary of State for Scotland, whether he has had recent discussions with the Scottish Government on the potential for a further independence referendum in the event of the UK leaving the EU.

I have had no discussions with the Scottish Government on this subject and do not expect to do so. A clear majority of voters in Scotland voted No in the independence referendum in 2014. That referendum was widely accepted to be a ‘once in a generation’ or ‘once in a lifetime’ event.

At the February European Council, the Government negotiated a new settlement, giving the United Kingdom a special status in a reformed European Union. The Government’s position, as set out by the Prime Minister to the House on 22 February, is that the UK will be stronger, safer and better off remaining in a reformed EU.

Nic Dakin – 2016 Parliamentary Question to the Ministry of Defence

To ask the Secretary of State for Defence, what proportion of enlisted soldiers attain (a) Level 1 and (b) Level 2 literacy and numeracy skills by the end of their third year of service.

The Army has traditionally linked the recording and attainment of english and maths qualifications to the point at which an individual is ready for promotion to Corporal or Senior Non Commissioned Officer ranks, rather than as a factor of time. The growth in numbers of personnel joining the Army and pursuing an apprenticeship has changed this approach and simplified the measurement of attainment by time.

Between 1 August 2012 and 31 July 2015 1,028 soldiers gained both Level 1 functional skills (FS) english and maths qualifications; and a further 722 soldiers gained the comparable qualifications at Level 2. This represents 11.8% of those enlisting (14,816) during the same period. This does not include those who gained just a functional skill in english or a functional skill in maths qualification, nor those who already held english and maths qualification on enlistment.

In total 23,699 FS (english and maths) qualifications at Level 1 and 2 were gained by Regular soldiers through apprenticeship and AEC provision in 2014-15. Of these 41% were at Level 1 and 59% at Level 2.

Lord Storey – 2016 Parliamentary Question to the Department of Health

To ask Her Majesty’s Government how many clinical negligence legal cases there have been in the last five years; and how many of those were settled by way of a payment for damages within six months of the trial date.

The National Health Service Litigation Authority (NHS LA) has provided the following data.

In the five financial years 2010/11 to 2014/15, the NHS received a total of 51,369 new clinical negligence claims. Many of these were resolved without the commencement of legal proceedings.

This figure relates to England only and does not include claims dealt with by insurers or Medical Defence Organisations, which between them handle the vast majority of claims involving private treatment and general practitioners.

Data on the payment of damages within six months of a trial date is not held.

Andrew Gwynne – 2016 Parliamentary Question to the Department of Health

To ask the Secretary of State for Health, whether his Department has had discussions with NICE on the Afinitor form of everolimus.

Departmental officials are in regular contact with their counterparts at the National Institute for Health and Care Excellence (NICE) about a range of issues, including individual medicines. This includes discussions on everolimus through the established topic selection processes for NICE’s technology appraisal programme and in relation to potential patient access schemes proposed by the manufacturer.

NICE has appraised everolimus for a number of indications and is currently appraising it for others.
