    To ask the Secretary of State for Justice, what the powers are of the Victims’ Commissioner.

    The role of the Commissioner for Victims and Witnesses is defined in the Domestic Violence, Crime and Victims Act 2004. It is to promote the interests of victims and witnesses, encourage good practice in their treatment, and regularly review the operation of the Code of Practice for Victims.

    The Commissioner can make proposals to the Secretary of State for amending the Code, may report to the Secretary of State in connection with her duties, may provide advice in relation to victims or witnesses as requested, and may make recommendations to authorities which fall within her remit.

    The Commissioner has no power to investigate individual cases or make recommendations on specific complaints. In line with the process set out in the Code, a victim is entitled to make a complaint to the service provider. If they remain dissatisfied they can refer their complaint to the Parliamentary and Health Service Ombudsman via their member of Parliament.

    We know there is more to do to further increase the rights of victims. We will announce our plans in due course.

    HM Treasury is working closely with Defra and other Government Departments on the development of the 25 Year Environment Plan. A cross-Government group, which includes Treasury officials, will ensure the Plan reflects the full breadth of relevant policy interests and levers that influence the environment.

    We continue to remain deeply concerned about the human rights situation in Yemen. The UK supported a UN Human Rights Council resolution in October 2015, which called on the UN to provide technical assistance to the Government of Yemen, assist the Yemeni National Independent Commission of Inquiry, and report back to the next session of the Human Rights Council. We continue to raise the importance of respect for human rights with all sides to the conflict.

    To ask the Secretary of State for Justice, what assessment he has made of the effects on children and families of the parental orders procedure following surrogacy arrangements.

    The Government has made no such assessment. Parental orders provide a mechanism to enable a couple who have entered into a surrogacy arrangement to become that child’s legal parents. There is no obligation to obtain a parental order but a couple who commission a surrogacy arrangement are advised and encouraged to do so in order to achieve a recognisable transfer of parenthood in the UK. In deciding whether to exercise its discretion and award a Parental order, the court has regard to all the facts of the case and the overriding importance of the welfare of the child throughout their life.

    To ask the Secretary of State for Transport, whether it is the Government’s policy that the EU Ports Services Regulation should be subject to the 12-month review procedure to assess its conformity with the principles of subsidiarity and proportionality agreed between the Prime Minister and the EU and that no further action should be taken to progress that regulation until that review has taken place.

    As part of the settlement secured by the Prime Minister, the European Commission has committed to establish in the future a mechanism to review existing EU legislation for its compliance with the principle of subsidiarity and proportionality. This is an important shift in how the EU operates. Negotiations on the EU Port Services Regulation (PSR) are ongoing and I am committed to defending the UK’s successful ports and to opposing any amendments that would damage the efficiency and competitiveness of our ports sector.

    To ask the Secretary of State for Defence, what proportion of local authorities have a dedicated Armed Forces Champion.

    407 Local Authorities at district level and above have signed Armed Forces Covenant pledges although signing the Covenant is not a mandatory requirement for these bodies. These are voluntary commitments as is the nomination of a Covenant Champion. Ministry of Defence officials are in contact with Covenant Champions for 287 Local Authorities some of whom will act as representatives for other Local Authorities in their area. Among those Local Authorities who do not have a champion, there are those who do have a dedicated point of contact for Covenant issues.

    There are credible reports that human rights violations have been committed by Nigerian security forces during its operations against Boko Haram. We welcome President Buhari’s commitment to overhaul the Nigerian armed force’s rules of engagement, to investigate credible allegations of human rights violations and to take appropriate action. We understand that there are a number of investigations currently underway. It is important that these investigations are comprehensive and credible, and we are monitoring these closely.

    We regularly stress to the Nigerian authorities the importance of protecting civilians in conflict and detention, and that, whilst we support their fight against terrorism, this fight should be in full compliance with human rights standards and international law. Any member of the Nigerian security forces found to have been involved in human rights violations must be held accountable.
