To ask the Secretary of State for Justice, how many prison staff from which prisons were dismissed for conducting inappropriate relationships with prisoners in (a) 2010, (b) 2013, (c) 2014 and (d) 2015.

Information on the number of cases of staff dismissed for having had an inappropriate relationship with a prisoner/ ex-prisoner are set out in the table below. Information on conduct and discipline cases is published in the Ministry of Justice Diversity Report on a financial year basis and to maintain consistency with these figures the table is presented in the same way.

No individual establishment had more than 5 cases in each year so only total numbers are provided in the table.
All figures are rounded to the nearest 10, with numbers ending in5 rounded to the nearest multiple of 20 to prevent systematic bias. As with all HR databases, extracts are taken at a fixed point in time, to ensure consistency of reporting. However the database itself is dynamic, and where updates to the database are made late, subsequent to the taking of the extract, these updates will not be reflected in figures produced by the extract. For this reason, HR data are unlikely to be precisely accurate, and to present unrounded figures would be to overstate the accuracy of the figures. Rounding to 10 accurately depicts the level of certainty that is held with these figures.

To ask the Secretary of State for Justice, what proportion of intermediaries were used for (a) witnesses, (b) victims and (c) defendants in the last 12 months for which figures are available.

In 2015, 7% of initial requests from the police and Crown Prosecution Service for a Registered Intermediary were related to witnesses (who were not victims in the case) and 93% to victims. We do not have a figure for how many of these victims then gave evidence as a witness. Information on intermediaries for defendants and the use of non-registered intermediaries is not held centrally.

To ask the Secretary of State for Justice, what information his Department holds on the number of prisoners who have converted to Islam in prisons in each of the last five years.

Information on the number of prisoners that have converted to Islam while in prison is not held centrally. The data held relates to a prisoner’s current declared religion, not any previously declared religion.
In order to provide data relating to offender conversions to Islam in prison, it would be necessary to manually examine individual prison records which could only be done at disproportionate cost.

To ask the Secretary of State for Justice, for what reasons the National Offender Management Service decided not to impose financial penalties on private prisons on each occasion when such penalties were applicable in the last five years; and what the value of those fines so foregone was.

Performance points are accrued when a custodial service failure occurs. Charges are then applied when the total points exceeds the relevant performance baseline. A performance baseline is allowed in recognition of the complex operational nature of prisons where we know that there will be occasional incidents no matter how well the prison is run. This charge protocol is a longstanding practice in prison contracts.
The performance points, and subsequent calculated charges, are signed off by all parties at the Quarterly Contract Review Meeting. Following this meeting, charge payable will, without exception, be collected by NOMS.
