    To ask the Secretary of State for Justice, what assessment he has made of the potential effect of his proposals to increase the cost cap for environmental legal challenges to £10,000 for individuals on the affordability of such challenges for such people.

    The Ministry of Justice will keep the impact of any changes to the cost capping scheme for environmental claims under review as part of its consideration of the consultation responses. We will also carry out a full impact assessment on any changes and this will be published as part of the government’s response paper.

    To ask the Secretary of State for Justice, when he plans to publish his Department’s evaluation of the Youth Justice and Criminal Evidence Act 1999 Section 28 pilots; and whether he plans to roll out provision of Section 28.

    Pre-trial cross examination under Section 28 of the YJCEA 1999 was piloted in three Crown Court centres. Fieldwork for a process evaluation of the pilot has been completed. A report is being prepared for publication, subject to standard quality assurance checks. The decision on the roll out of Section 28 will be made in due course, following the results of the evaluation.

    To ask the Secretary of State for Justice, what assessment he has made of the potential effect of proposals to revise the costs capping scheme for environmental legal challenges on the UK’s ability to meet the requirement in the EU Public Participation Directive for claimants to have prior certainty in relation to costs protection.

    The Government’s proposals to revise the costs capping scheme for environmental legal challenges in England and Wales have been brought forward in light of recent developments in case law. Following those judgments the Government has made an assessment and considers there to be scope for introducing measured adjustments to the current regime within the framework of EU law, including the Public Participation Directive.

    To ask the Secretary of State for Justice, what estimate he has made of how much his Department will have spent on implementing digitalisation requirements by April 2016 at the courts and tribunals proposed for closure in the recent Proposal on the provision of court and tribunal estate in England and Wales consultation.

    Her Majesty’s Courts and Tribunals Service are committed to delivering a quicker and fairer justice system. The digitalisation programme is on track to deliver £220m of benefits.

    Investment of digital technologies to court centres under consultation was immediately paused pending the outcome of this process. £1.35m had previously been spent in courts which have subsequently been announced for closure. The vast majority of this expenditure was in re-usable hardware assets which will be reallocated to other sites within the HMCTS estate. Additionally, the savings from the installations are expected to outweigh average installation costs by the time courts start to close.

    To ask the Secretary of State for Justice, how much has accrued to the public purse from criminal courts charges since their introduction.

    Data relating to the criminal courts charge for the period April to September 2015 will be published on 17 December 2015.

    Enforcement action is taken against the total amount an offender owes and offenders are often ordered to pay more than one type of financial imposition.

    The cost of enforcing the criminal courts charge cannot be separated from the total cost of enforcing all types of court ordered financial impositions.

    It is not possible to identify how many people have had a criminal courts charge imposed in magistrates or crown courts or for specific offences without carrying out a manual search of all financial imposition accounts which would incur disproportionate costs.
