    To ask the Secretary of State for Health, if he will require NHS England to set out commissioning responsibilities for mental healthcare.

    NHS England has a five-year strategy – the Mental Health “Five Year Forward View” to improve mental health outcomes across the National Health Service, for people of all ages. The Forward View explains how national bodies will work together between now and 2021 to help people have good mental health and make sure they can access evidence-based treatment rapidly when they need it.

    In relation to commissioning, NHS England has direct commissioning responsibility for a number of specialised mental health services – as set out in regulations. These services include: adult secure in-patient services; in-patient services for children and adolescents; in-patient perinatal services; gender identity services; specialist in-patient services for people who have a mental health illness and are deaf; in- patient services for patients who have eating disorders and some specialist personality disorder in-patient services.

    The Mental Health Taskforce report – published in February, recommended that NHS England should ensure that by April 2017 population-based budgets are in place, which give clinical commissioning groups (CCGs) or other local partners the opportunity to collaboratively commission the majority of specialised services across the life course.

    CCGs are responsible for commissioning all other mental health services for both adults and children; working with partners such as local authorities, where appropriate.

    To ask the Secretary of State for Health, what estimate he has made of the costs to his Department associated with unmeritorious claims resulting from changes to a fixed cost recoverable scheme for clinical negligence.

    The Department is working closely with stakeholders to develop the proposal to introduce fixed recoverable costs. We have undertaken a pre-consultation exercise with a number of key stakeholders, including representatives of claimant lawyers, and are planning an open public consultation shortly. We welcome views on the proposal from all sectors.

    The consultation documentation, including the Impact Assessment, will be published in early 2016 subject to relevant Committee clearances. We are working upon the assumption that there is nothing about Fixed Recoverable Costs regime which will alter the percentage of unmeritorious claims.

    Any scheme proposed will include consideration of the right incentives to support a fairer and quicker process that provides the improvements to the system whilst maintaining access to justice.

    The NHS Litigation Authority reported in their annual report for 2014/15 that it resolves over 4,000 clinical negligence cases annually for no payment of damages and in 2014/15 it saved over £1.2 billion for the National Health Service in rejecting claims which had no merit.

    To ask the Secretary of State for Health, how the Government plans to phase increases to funding for NHS England over the next five years; and what the Barnett consequentials of decisions on such phasing will be.

    The Spending Review announced on 25 November the level of funding that the NHS in England would receive by 2020-21. The NHS will be receiving £10 billion more per year in real terms by 2020-21 than in 2014-15, which fully funds the NHS’ own plan – the ‘Five Year Forward View’. £6 billion of that £10 billion will be delivered by 2016-17. This is set out in the attached table.

    The exact budget profile for NHS England will be set out in the Mandate to NHS England, due to be published shortly.

    Under the Barnett Formula, Scotland, Wales and Northern Ireland receive a population-based proportion of changes in planned spending on comparable United Kingdom Government services in England. Changes in each devolved administration’s spending allocation, is determined by:

    – the quantity of the change in planned spending in departments of the United Kingdom Government; and

    – the extent to which the relevant United Kingdom programme is comparable with the services carried out by each devolved administration and each country’s population proportion.

    The allocation of public expenditure between the services, including health, under the control of the devolved administrations is for the devolved administrations to determine.

    To ask Her Majesty’s Government whether any part of the proposed HS2 rail line is to be built on a flood plain.

    Given HS2 is a national infrastructure project of over 350 miles, HS2 does currently plan to cross floodplains. For Phase One, the assessment of all sources of flood risk can be found in Volume 5 of the Environmental Statement. For Phase Two, flood risk is detailed in the Appraisal of Sustainability.

    HS2 Ltd has a design aim that, for the lifetime of the development, there should be no increased risk of flooding for vulnerable receptors, including residential property, taking projected climate change impacts into account. The design of HS2 does consider the practicalities of a range of environmental factors, including flooding.

    The Community Transport Minibus Fund will provide over 300 organisations with a new minibus so that they can continue to provide vital services to help elderly residents, people with learning and physical disabilities and those who do not have access to a commercial bus service.

    Approximately one third of the organisations obtaining vehicles through the Fund are based in rural areas.
