    To ask the Secretary of State for Justice, how many cases were stopped as a result of witness withdrawal or non-attendance in (a) Crown court trials and (b) hearings in magistrates’ courts relating to (i) domestic violence (ii) rape and (iii) other cases in each of the last five years.

    Criminal cases discontinued by the prosecution are recorded by Her Majesty’s Courts & Tribunals Service (HMCTS). However, the reasons why a case was discontinued are only recorded centrally for cases which are listed for trial but do not go ahead on the day. The reasons for these ‘cracked’ trials, including ‘prosecution end case’, are published at https://www.gov.uk/government/collections/criminal-court-statistics in the supplementary Criminal Courts transparency tables. These data are not broken down by offence.

    The reasons recorded for cases discontinued at any other point in proceedings are not held centrally by HMCTS. This information could only be provided at disproportionate costs.

    It is for the local National Health Service to manage accident and emergency services to ensure access to high quality, safe services for their local populations.

    We are making additional resources available to the NHS to deal with increased demand, by backing the NHS Five Year Forward View with £10 billion a year real terms additional funding by 2020-21, compared to 2014-15, with £3.8 billion real terms growth in 2016-17.

    Information on ambulance handovers delayed over 30 minutes was published by NHS England in winter daily situation reports each weekday during winter from 2010-11 to 2014-15. Such information is not being published by the NHS in winter daily situation reports for 2015-16. The data can be found using the following link:

    The indicative spend for NHS England commissioned HIV services for 2014/15 is £539 million. This figure is for the total indicative spend on HIV not just drugs, as it is not possible to extract the spend on HIV drugs alone for 2014/15. Accurate data on spend on HIV drugs from previous years is not available.

    To ask Her Majesty’s Government, in the light of the result of the referendum on the UK’s membership of the EU, what measures they plan to take to ensure the UK’s continued participation in EU-wide data sharing initiatives for clinical trial development and condition-specific patient registries.

    The Government recognises the importance of our research base, which is why we have protected the ring fenced science resource budget in real terms from its current level of £4.7bn for the rest of the parliament. Programmes such as the £1.5bn Global Challenges Research Fund and the £1bn Ross Fund will support the UK’s status as a global leader in medical research.

    The Global Challenges Research Fund will mobilise the UK’s world leading research base to address key challenges facing developing countries, including in health research. The Ross Fund will develop, test and deliver a range of new products (including vaccines, drugs and diagnostics) to help combat the world’s most serious diseases in developing countries.

    The referendum result has no immediate effect on the right of researchers to apply to or participate in EU research programmes. UK participants can continue to apply to the programmes in the usual way. The future of UK access to these programmes will be determined as part of a wider discussion with the EU.

    To ask the Secretary of State for Health, what plans he has to ensure early access for the immuno-oncology treatment nivolumab for both lung cancer and melanoma.

    Nivolumab (Opdivo) received a positive scientific opinion under the early access to medicines scheme for melanoma in May 2015 and for lung cancer in June 2015. Nivolumab was subsequently licensed for the treatment of advanced (unresectable or metastatic) melanoma in June 2015 and for locally advanced or metastatic squamous non-small cell lung cancer after prior chemotherapy in July 2015.

    The National Institute for Health and Care Excellence (NICE) is currently developing technology appraisal guidance on the use of nivolumab for the treatment of:

    – advanced, unresectable, metastatic melanoma – final guidance expected in May 2016;

    – non-small-cell, squamous, metastatic lung cancer (after chemotherapy) – final guidance expected in May 2016; and

    – untreated, advanced, unresectable, metastatic melanoma (with ipilimumab) – final guidance expected September 2016.

    Commissioners are legally required to fund drugs and treatments recommended in NICE technology appraisal guidance within three months of its final guidance being issued. In the absence of guidance from NICE, it is for commissioners to make decisions on whether to fund new medicines based on an assessment of the available evidence.

    We take the issue of ensuring rapid access to innovative therapies very seriously, which is why we have launched an independent Accelerated Access Review to make recommendations to Government on speeding up access for National Health Service patients to innovative and cost effective new medicines, diagnostics, medical technologies and digital products. The review published its interim report on 27 October 2015 and its full report and recommendations are expected in spring 2016.

    The number of (a) young offenders and (b) staff the Youth Justice Board recorded as injured in each young offender institute in each of the last eight years is set out in the attached table.

    The table includes information on injuries, including severe injuries, relating to Restrictive Physical Intervention (RPI), self-harm and assaults. The number of staff and visitors severely injured as a result of an assault is not included as obtaining these figures would incur disproportionate costs.
