    To ask the Secretary of State for Energy and Climate Change, what discussions his Department has had with other government departments on extending the winter fuel payment to people on the higher rate of disability living allowance for care or mobility and the equivalent enhanced rate of the new personal independence payment; and if he will make a statement.

    Winter fuel payments is a DWP policy.

    However, people with disabilities may be able to access the Warm Home Discount Scheme and receive a rebate off their electricity bill. They may also be able to access the Energy Companies Obligation through which they can get help with insulation and heating measures.

    The statutory guidance, ‘Working Together to Safeguard Children, 2013′, is very clear that the effective sharing of information between professionals and local agencies is essential for accurate identification, assessment and provision of services for vulnerable children. The Department for Education’s policy is clear that fears about sharing information cannot be allowed to stand in the way of the need to promote the welfare and protect the safety of children.

    To ask the Secretary of State for Education, whether the National College for Teaching and Leadership (NCTL) has received any allegations of child abuse in independent schools that occurred before the establishment of the NCTL; and what powers the NCTL has to follow up any such allegations.

    I refer the hon. Gentleman to the answer I gave on 3 March 2014 to the hon. Member for West Bromwich East, Official Report cols 676-7W. 16 of the cases referred to relate to incidents that are alleged to have occurred prior to the establishment of National College for Teaching and Leadership (NCTL).

    The Teachers’ Disciplinary (England) Regulations 2012 provide NCTL with the power to regulate teachers including those in independent schools. These regulations provide for any referral to be investigated regardless of the date of the alleged incident.

    The Department for Education published for consultation in January of this year draft statutory guidance to local authorities on the care of unaccompanied asylum seeking and trafficked children.

    This new guidance brings together guidance on transition planning with wider guidance on providing care for unaccompanied asylum seeking children. That consultation has now closed and final guidance will be published in due course.

    To ask the Secretary of State for Education, if he will take steps to ensure that governors are disqualified when a school governing body is found guilty of disability discrimination.

    Regulations set out the circumstances in which a person is disqualified from holding or continuing to hold office as a governor at a maintained school. These include bankruptcy, conviction for an offence carrying a sentence of imprisonment, disqualification from being a company director or charity trustee, and persons whose employment is prohibited or restricted.

    The Department for Education has issued advice to school governing bodies on their duties under the Equality Act 2010, including in respect of disability.

    It is for governing bodies of state-funded schools to comply with any orders of the First-tier Tribunal (Special Educational Needs and Disability) in relation to claims of disability discrimination.

    For Jobseeker’s Allowance (JSA), guidance on the requirement to have £16000 or less in capital and savings is in the JSA procedural guidance. Corresponding guidance for Decision Makers is in the Decision Makers Guide, chapter 29.
