    Marsha De Cordova – 2023 Speech on the Health and Disability White Paper

    Thank you, Mr Speaker, for granting this urgent question.

    Although we know that most of the proposals set out in the White Paper will not be implemented until the next Parliament, a significant number of ill and disabled people will be impacted. We see the Government using a carrot-and-stick approach, which will leave many sick and disabled people with the stick and the real threat of the ramping up of sanctions, as indicated by the Chancellor during his Budget statement yesterday. Just this week the Information Commissioner’s Office ruled that the Department for Work and Pensions must release “sensitive” research into its sanctions regime following the Work and Pensions Committee report, which found that there is very little evidence that the sanctions work. Instead, it found that they have a significant impact on the health and finances of those who have been sanctioned. There are real consequences to some of the Government’s actions.

    Nobody is arguing that scrapping the work capability assessment is not welcome. However, relying solely on the PIP assessment is not the solution, given the current experiences of PIP assessments, which show that they are deeply flawed; the DWP is losing or conceding in four out of five appeals. Moreover, the Institute for Fiscal Studies said yesterday that up to 1 million people currently on incapacity benefits could lose out as a result of scrapping the work capability assessment and relying on using PIP only. Also under the new proposals disabled people will not automatically be in the “no work-related requirements” conditionality group and will now be subject to the decisions of a work coach.

    We also did not hear any additional investment in the Access to Work scheme, so can the Minister say how many people will be impacted and what the cost is of these new proposals? It is estimated that 1 million people will lose out. How are the Government intending to mitigate that? Will the PIP assessment framework change or stay as it currently is? Given the poor decision making on so many PIP assessments, what action is being taken to fix the flawed decision-making process and the assessment itself? How will the DWP ensure that the policy proposals do not remove vital protections against sanctions and risk pushing people further into poverty? Finally, when are the Government intending to publish the sensitive research into the sanctions regime?

    I am hugely appreciative of the hon. Lady, who always speaks with great passion on these issues. I welcome the cautious welcome from her about the broad thrust of the reform we are trying to deliver, which is to remove the structural disincentive to work. That manifests itself in the many conversations I have with disabled people and their representative groups, when they tell me that many disabled people would like to try to work, but fear doing so and then losing their entitlement if it does not work out. That is not an acceptable situation, and it is right that we change it. I hope that as a House, as we move forward with these reforms, we can come together and deliver something that achieves that objective, which is plainly the right thing to do.

    It was before my time in the House, but I well remember debates in previous years about the work capability assessment. It is welcome that we are scrapping the work capability assessment through these reforms. The reforms also offer an opportunity to focus on quality when it comes to the PIP assessment and on making sure that we get the right decisions first time. The hon. Lady will note, for example, that one of the commitments we have made in the White Paper is trying to match specialist assessors with people’s conditions. That is another thing people have regularly been asking for, and we are determined to test that and see what difference it can make. Again, this is all about being responsive to the feedback we have received.

    On the issue of sanctions that the hon. Lady mentioned, I know that the legal case she touched on is under consideration by Ministers elsewhere in the Department at the moment. No doubt we will come forward and say more about that in due course, but I want to be clear that it is not my intention or the Department’s intention to force anyone to do something that is not right for them. We are committed to personalised, tailored support that meets individual needs and aspirations. The Secretary of State will talk about that in more detail during the Budget debate later. A lot of that will be voluntary. I would hope that people will want to engage with universal support and will want to engage with Work Well, because this is about trying to help and support people. For people with health conditions, for example, this is a way in which we can work harder and tirelessly with them to help them get better. Work is of course an important determinant of better health outcomes. The White Paper is explicit in saying that we will move forward with this in a way that is appropriate for individuals. For those where work is not appropriate, they will not be expected to do it.

    It is also important to set out for the House that there will be transitional cash protection in place. No one who currently has limited capability for work or work-related activity will lose out as they move to the new system. We are specifically protecting those with pregnancy risk or who are undergoing cancer treatment, and we are also keeping a contributory health and disability benefit. Of course, what I really want to do—this is key to all of the work I do in this role—is to work constructively with the hon. Lady and with disabled people and their representative groups to make sure that we get this reform right. This is the biggest welfare reform for over a decade, and we have to get this absolutely right.

    That this House has considered e-petition 617603, relating to the state pension.

    It is a pleasure to serve under your chairmanship, Sir Robert. I thank the hon. Member for Glasgow East (David Linden) for his point of order.

    I start by congratulating Michael Thompson on creating the petition, as well as the creators of the six other petitions being debated today. I thank Age UK and Silver Voices for their briefings, and the whole of the Petitions Committee team for all their hard work. The petition calls on the Government to increase the state pension to £380 a week, and to lower the retirement age back to 60. The petition has already been signed by more than 110,000 people.

    The current full state pension is £185.15 per week, and the basic state pension is £141.85. Many of us are here today because we believe that the state pension should provide adequate financial support for the 12 million pensioners in the UK, ensuring that they are protected in old age after paying into the system. Given this country’s wealth, we can afford to look after our pensioners. By increasing the state pension or introducing a minimum pension income guarantee, we could lift thousands of pensioners out of poverty.

    While financial support is vital, the issue is not just about money. Measures to address pensioner poverty must include a broad range of actions to underwrite acceptable living standards, including support for our wider public services, such as social care to support our pensioners to live independently, and day centres to reduce loneliness and social isolation. On that point, I thank Age UK Wandsworth in my Battersea constituency. I visited last week and met many of the older people who value the services provided by that day centre, but they really want more access to it, more often. More importantly, all of them wanted the state pension to increase.

    Poverty and inequality among pensioners are rising, with more than 2 million people in relative poverty. There are many reasons why some are falling into poverty. The first and most urgent is the cost of living crisis. Research by the Centre for Ageing Better found that a further 200,000 elderly people have already been pushed into poverty in the last year, and a recent report by Age UK found that this Christmas will be among the most difficult ever for nearly 3 million older people.

    The measly 3% rise in the state pension this financial year was dwarfed by inflation and the intersecting impacts of rocketing food, fuel and energy bills, with the latter alone forecast to rise to £3,000 by next April. After shamefully reneging on their manifesto commitment on the triple lock last year, the Government finally committed to its reinstatement, as well as a cost of living payment for pensioners, in last month’s autumn statement. However, given that neither measure is scheduled to come into force until next year, they will be too little, too late for many who need the support right now. The misery is compounded by cuts to public services and the Government’s U-turn on their social care reforms: 10% of older people will reduce or stop their care in the coming months because of the cost of living crisis.

    These causes of poverty only add to the challenges faced by pensioners. Although older people have a higher rate of home ownership than the general population, many are asset rich but cash poor. That means that some are driven to sell their homes to make up for shortfalls in pensions and are pushed into the higher-cost private rented sector.

    Inequalities in state pension rates are also dragging the elderly into poverty. Department for Work and Pensions statistics for the 2020 financial year show that less than 10% of all pensioners received the full new top rate of pension—£185.15—and less than a third of those on the old pension receive the full rate.

    The rise in the eligibility age for the state pension from 65 to 66 from 2018 has also increased hardship. According to the Institute for Fiscal Studies, more than 700,000 65-year-olds have missed out on entitlements and postponed retirement. The elderly are compelled to remain in the job market, and they simultaneously lack opportunities to increase their income. The Government need to consider targeted support for people who are much older as endemic age discrimination in employment affects their ability to build a work pension or find work to complement their state pension.

    The third factor is the pension credit system, which can play an important part in helping to close the pensioner poverty gap, especially for women, disabled people and black, Asian and ethnic minority pensioners. Since Labour introduced the measure, its efficacy has been undermined by low take-up. In its July report, the Work and Pensions Committee stated that

    “an estimated further 850,000 eligible households are not claiming Pension Credit worth £1.7 billion a year.”

    It strongly recommended that the Government improve the identification of eligible people, streamline the application process and make it more accessible.

    The risk of pensioner poverty is amplified for women, disabled people and black, Asian and ethnic minority pensioner groups. Women disproportionately experience later-life poverty, with the proportion of those suffering rising from 14% to 20% in the eight-year period from 2013. The equivalent figures for men were 12% and 18%. Those figures are expressions of the wider inequalities endured by women. The Women Against State Pension Inequality Campaign highlights a particularly egregious instance of those disparities. The Government have a legal and moral obligation to deliver for the many WASPI women in our constituencies. Pensions, lifetime earnings and national insurance contributions are typically lower for women due to the gender pay gap and caring responsibilities—we are all aware of those factors.

    For black, Asian and ethnic minority pensioners, the inequalities are even starker. According to Age UK, 33% of Asian and 30% of black pensioners are in poverty—double the proportion of their white counterparts. Similarly to those faced by women, these inequalities are the expression of lower average wages and labour market discrimination, which translate to less generous state pensions. That has often led to some ethnic minority people earning below the minimum salary threshold for auto-enrolment in workplace pensions. Lowering that threshold would be an easy fix for this injustice; according to a report by The People’s Pension, it would double the enrolment of ethnic minority employees.

    Employment and pay disparities also create later-life poverty for disabled pensioners, who are less likely to possess a work pension or a private pension as a result. We know that those effects will be exacerbated by higher living costs of around £600 per month on average for disabled people, including older disabled people.

    All that shows emphatically that some pensioners are really struggling. The Government need to look at how they can support them. I hope that the Minister will address the issues I have raised, as well as making reference to the following points. First, the Government talk a lot about tackling pensioner poverty. If they are serious about doing so, why will they not commit to increasing the state pension, or introducing a minimum pension income guarantee for everybody, irrespective of their contribution record, their sex and gender, their age or their marital status?

    In the current crisis, the additional cost of living payments announced in last month’s autumn statement clearly will not be enough for some pensioners. Will the Government therefore introduce additional financial support targeted at those pensioners who are most in need?

    Have the Government carried out an impact assessment of how the delay caused by the U-turn on social care reform will impact our pensioners? What plans do they have to address the inequality I highlighted of the low percentage of people on the full new state pension rate?

    My next point is probably the most crucial; it concerns pension credit. Why will the Government not deliver a take-up campaign to identify eligible pensioners, and introduce a streamlined and accessible application process, so that the pensioners who are entitled to that additional top-up can receive it? Pension credit is there to top up income, and I strongly believe that the Government could be proactive in identifying pensioners who might qualify.

    The WASPI women need justice. When will the Government provide compensation for the failings? Will they commit to ensuring that there is a proper, lengthy notice period for any future change to the state pension age?

    Will the Government seek to bring down the minimum salary for auto-enrolment to workplace pension schemes? That would increase the participation of under-represented groups, particularly our black, Asian and ethnic minority communities.

    We all know, particularly at this time of year, that loneliness and social isolation are key contributors to material deprivation. More investment is needed in public services and the social support networks that are available to older people; in fact, we need an overarching strategy to address that. What are the Government doing to support community and local organisations, such as Age UK Wandsworth in my constituency? It provides a lifeline and vital services to people who live in the local area. I reiterate the point I made earlier: because of the funding available, many can attend that centre only a couple of days a week, but they would like to go three or four times a week. It is unfair that the time they can spend at such centres is being limited.

    Finally, I call on the Government to explore alternative ways to fund our pension system. The state pension is unfunded, meaning that its obligations are not underpinned by assets that could generate investment and return. That funding model is implicitly appealed to when the Government object to the rising cost of pensions due to our ageing population and the impact that will have on younger people, although that probably does not apply to any of us in the Chamber, as none of us is very young. [Interruption.] Well, some might be. However, an appreciation of funding models used in other countries could point the way towards a systemic shift that could help fund the state pension system.

    We owe it to our elderly and all our pensioners, as well as to the generations that come after us, to be progressive in our thinking and innovative in our approach. We must look at all options to ensure that when people reach their later years they will not fear retirement but embrace it, because they will know that, in the state pension system, there is a safety net in place to support them and they will not be struggling.

    I beg to move,

    That leave be given to bring in a Bill to require the Secretary of State to publish a national eye health strategy for England; and to require that strategy to include measures for improving eye health outcomes, for reducing waiting times for eye health care, for improving patient experiences of eye health care, for ensuring that providers of eye health care work together in an efficient way, for increasing the capacity and skills of the eye health care workforce, and for making more effective use of research and innovation in eye health care.

    The Bill would ensure that regardless of where one lives, everyone can access the right care where and when they need it, eliminating the postcode lottery and addressing the inequalities in access to eye care services. An estimated 2 million people are living with sight loss in the UK. We rely on our eyes every day, yet we do not give much thought to our eye health until our vision changes.

    A report earlier this summer showed that 17.5 million adults in the UK had not had an eye test in the past two years, as recommended. Anyone can be impacted by sight loss, and Members from across the House will have hundreds of constituents affected. Fifty per cent. of all sight loss is avoidable and 250 people begin to lose their sight every day, with a shocking 21 people a week losing their sight due to a preventable cause.

    Eye care services in England are under intense pressure due to huge backlogs as a result of the pandemic, demand from an ageing population and low recruitment and retention of all groups of the ophthalmology clinical workforce. More than 650,000 people are on the waiting list in England, of whom 37% have been waiting for over 18 weeks and over 4% have been waiting for more than a year—that is, 26,000 people who have been waiting for more than 12 months to see a specialist.

    Ophthalmology has been the busiest NHS out-patient clinic for the past three years. Delays to diagnosis and treatment can lead to a complete loss of sight. For example, patients with age-related macular degeneration can experience rapid and sometimes complete central vision loss within weeks if not treated. As well as the social and emotional impact of sight loss, there is a huge economic cost to the UK economy, which is estimated to be £36 billion annually.

    To respond to the crisis in eye health, the Government can commit to implementing a national eye health strategy for England that would include measures to improve eye health outcomes, reduce waiting times, improve patient experiences, increase the capacity and skills of the workforce and make more effective use of data, research and innovation.

    In the first instance, the Government could seek to appoint a single Minister with responsibility for eye health rather than having the current situation where multiple Ministers are responsible.

    The strategy should include the following areas. First, there should be an eye health and sight loss pathway to require care and support for those with sight loss, focusing on the provision of non-clinical community support to complement the work of community optometrists, ophthalmologists in hospitals and rehab officers. The pathway must focus on the physical and emotional impacts of being diagnosed with sight loss, as research has shown that people affected are likely to experience poor mental health lifetime outcomes such as depression and anxiety. It should not only address geographical eye health inequalities, but ensure more equity of access to eye care among communities and populations more at risk of being unable to access NHS sight tests, including people who are homeless and people with a learning disability.

    The second area is to improve connections between primary and secondary care, with an emphasis on integrated care systems and on improving the relationships and collaboration across the two services so that they can work more effectively together while ensuring timely and accurate referrals. That would significantly improve patient experiences and health outcomes.

    The third area is workforce expansion. Limited capacity is a particular concern in eye care because there is a significant shortage of eye doctors. Back in 2018, the Royal College of Ophthalmologists revealed that 434 additional specialist posts were required to meet demand, and we know that the situation is now even worse. The World Health Organisation’s Workforce 2030 plan recognises the fundamental role of the workforce in improving health outcomes. A national strategy for eye health must address that issue, placing emphasis on the recruitment, training and upskilling of medical and non-medical eye health professionals.

    The fourth area is health intelligence and data. Meaningful action starts with good-quality data, but for too long population data has not been used effectively to pinpoint the location of need and places where opportunities for change can be found. A strategy should involve focusing on robust data collection to inform decisions and improve the delivery of the service. Advances in research and technology, from how people are diagnosed to how they receive treatment, must be incorporated. Effective and efficient methods are available, but they are not being used. A strategy would change that.

    Finally, the fifth area is raising awareness of eye health by creating better public health messaging. Nearly 2 million people each year turn up at an accident and emergency department or try to get a GP appointment for a problem that could be dealt with by visiting a community optometrist. We need campaigns to raise awareness of the importance of maintaining good eye health and to educate the public on the differences between eye screening and eye tests, along with improved signposting on where to go for help, should one need it.

    Health strategies have delivered positive outcomes in Scotland, as they have in England for other diseases, but at present England is the only country in the UK without an eye health strategy. It is important to note that for such a strategy to be successful and of value, it must be designed in collaboration with stakeholders, including blind and partially sighted people, civil society groups, care providers and the industry. It must also have sufficient resource and investment.

    Given the scale of the problems, it is in the Government’s interest to commit to a strategy. The benefits would transform lives, alleviate pressures on the health service and reduce economic costs. We should make it our goal to ensure that no one loses their sight unnecessarily. I thank everyone who has contributed to the Bill, including the partnership The Eyes Have It, the Thomas Pocklington Trust, industry leaders such as Specsavers and Roche and, most importantly, people living with sight loss. The sector has been united in the call for a national eye health strategy. It is time for the Government to act.

    Marsha de Cordova – 2022 Comments on the Resignation of Liz Truss

    The comments made by Marsha de Cordova, the Labour MP for Battersea, on Twitter on 20 October 2022.

    It is right that the Prime Minister has resigned. She never had the mandate or authority to govern our country.

    Under her leadership, the country lurched from one crisis to another. In 45 days, she had crashed the economy, the pound and the reputation of the country. Many of my constituents will pay the price for her and the Tory Party’s reckless actions.

    They should be utterly ashamed of their actions over the past year, first under former Prime Minister Boris Johnson and now Liz Truss. Once again, they put their interests over that of the country and caused serious long-term damage.

    Their behaviour shows the true level of entitlement and contempt they have for the people.

    We are living in a Tory crisis: made in Downing Street, paid for by the people.

    We urgently need to restore integrity and trust in our democracy. This starts with a General Election.

    The tribute made by Marsha De Cordova, the Labour MP for Battersea, in the House of Commons on 9 September 2022.

    It is an honour to speak not only on my own behalf but on behalf of my constituents and to pass on their condolences. The passing of Her Majesty the Queen is a great loss for the royal family and for our country. As our longest-reigning sovereign, our remarkable Queen dedicated 70 years of her life to serving our country. She devoted her life to the betterment of this country, and today we celebrate her service and express our thanks for her steadfast leadership. The Queen was a role model and touched the lives of so many in her own unique and distinguished way.

    Over the course of the Queen’s reign, there was great transformation and progress in the world, yet she served as a constant and reassuring figure during periods of change and provided us all with a sense of security. She was incredibly resolute and principled, and she had a work ethic and a commitment to duty and service that she placed above all other considerations. Even in her 90s and in the days before her death, she was still working and serving our country.

    The Queen’s strong and abiding faith in God was the golden thread that guided her work and her commitment to respecting everybody, appreciating difference and serving people. Across Battersea, people will be reflecting on her selfless service and leadership of our country. She visited the constituency on many occasions, including the then children’s home on the Winstanley estate and, of course, Battersea Dogs & Cats Home. We all know how passionate she was about animals and their welfare, and that was shown by her patronage of the home. As staff at the home have already said this week, they were so lucky to have had such a valuable relationship with her. But she was not just our Queen, as we can see from all the global contributions and tributes that have come her way.

    As I close, my thoughts and prayers are with His Majesty King Charles and the royal family. May Her late Majesty rest in peace and rise in eternal glory. God save the King.

    This year is the 50th anniversary of the Battersea funfair disaster. I want to start by remembering the victims, their families, and the survivors. I also want to pay tribute to and thank two of the survivors, Hilary Wynter and Liz Haigh-Reeve, for their tireless campaigning to have the tragedy recognised and remembered.

    The Big Dipper rollercoaster was the main attraction of the Battersea Park funfair which opened as part of the festival of Britain. Tragically, on 30 May 1972, a carriage of the rollercoaster broke loose and plummeted backwards through a barrier killing five children—Alison Comerford, Thomas Harmer, Shirley Nash, Debora Robertson and David Sait—and leaving 13 injured. The disaster is one of the deadliest rollercoaster crashes in history. However, it has largely been forgotten and there has been no justice for the victims, their families and the survivors.

    To mark the anniversary of the disaster, I attended a special memorial ceremony together with families and survivors in Battersea Park where a plaque was unveiled and a tree was planted. That is the first step to creating a new legacy and a permanent memorial.

    There is another silent tragedy associated with the incident, on which I will focus the rest of my speech. It is something that I am determined to change. Survivors have spoken about the devastating impact that childhood mental trauma has had on their lives. As one told me,

    “bones are mended, physical injuries fixed, but the dreadful damage to our mental health goes untreated.”

    Damage from trauma is not necessarily skin deep: some wounds penetrate through to our minds, leaving lasting damage that can be just as debilitating. Although the funfair and the big dipper are long gone, some of the survivors of the disaster still struggle to go to Battersea Park, and have been unable to shake off their horrific memories of that incident. I am sure many survivors of other tragedies, such as Hillsborough, the Manchester Arena terrorist attack and the Grenfell Tower fire, have been through similar experiences.

    I commend the hon. Lady on securing this debate on childhood trauma support services. I would mention helpfully to her, and probably to the Minister as well, that we in Northern Ireland have faced 30 years of a terrorism campaign during which many young children, women and men have lost their lives. Such trauma can last way beyond the time that it happened. Does the hon. Lady agree that some discussions with the responsible Minister in Northern Ireland might be helpful when it comes to devising a policy and a strategy to address trauma and child mental issues, which I know she wishes to see?

    The hon. Gentleman is right: we can all learn, and it would be useful for the Minister to say whether she would like to meet Ministers in Northern Ireland to look at what works well.

    Childhood trauma can have a lifelong effect, and can have lasting consequences for a child or young person’s development, including psychological, behavioural and emotional problems. Those problems can occur into and throughout adulthood, presenting related challenges in many aspects of that person’s life. According to the UK Trauma Council, childhood trauma refers to the ways in which some events and experiences are so extreme that they overwhelm a child’s ability to cope. Many different experiences can lead to such trauma: for example, physical or sexual abuse can be traumatic for children. One-time events like the tragedies I have mentioned can take a psychological toll on children as well. Ongoing stress such as the effects of the pandemic can also be traumatic for a child, even if it just feels like everyday life to an adult.

    We know that the pandemic has had a huge negative impact on children and young people’s mental health and wellbeing. The Children’s Commissioner’s Big Ask survey found that one in five children was not happy with their mental health, and that figure rose to two in five for some groups. Childhood trauma does not have to involve experiences that are directly related to the child: for instance, watching a loved one endure major issues can be extremely traumatic, as has been highlighted by the impact of the cost of living crisis on children’s mental health. According to the Childhood Trust’s latest report, 47% of children surveyed felt stressed, 21% of parents said that their children smiled less, and most concerningly, 9% of parents claimed that their children had started self-harming. The results of that report should worry us all, as all those types of trauma will affect children’s development and wellbeing.

    The Government need to invest in mental health services to ensure that children who experience trauma today do not face the same painful ordeal that survivors of the Battersea funfair disaster have gone through over the past 50 years. Spending on children’s mental health remains behind investment in adult mental health services. It is worrying that children and young people’s mental health services are among the most under-resourced and that the quality of care varies between different parts of the country. A BBC freedom of information request revealed that 20% of children are waiting more than 12 weeks to be seen for mental health support. That is why I was pleased to secure this debate on better provisions for children’s mental health services and childhood trauma.

    The Government need to correct the historical underinvestment in children and young people’s mental health and the postcode lottery of services and support provision. To do that, they must create a comprehensive child mental health strategy, and childhood trauma services must be prioritised as part of that. The UK Trauma Council has called for the Government to invest in the development and delivery of specialist trauma provision so that children and young people have access to the support that they need. It also called on the Government to equip all professionals who work with children and young people with the skills and capacity to support those who have experienced trauma.

    Labour has already set out its plan on tackling the mental health crisis, which includes giving adequate funding to mental health services. We have also committed to radically expanding the mental health workforce, including, crucially, investment in children’s mental health that includes putting open-access mental health hubs for children and young people in every community and ensuring that a full-time mental health professional is in every secondary school and a part-time professional is in every primary school.

    Labour’s focus on early intervention is so important, because it can prevent the ongoing effects of trauma into adulthood. It would ensure that children are properly supported and resolve problems before they escalate. I will therefore ask the Minister about the Government’s plan for children’s mental health services and, specifically, childhood trauma care. When will her Government introduce a comprehensive child mental health strategy that includes prioritising trauma and investment in the development and delivery of evidence-based trauma service provision? How are they ensuring that children’s mental health services are a high priority in the NHS? That includes increased investment.

    The Government have made £139 million available to support children and young people’s mental health in the community, but we need to see more investment. How are the Government working with professionals in contact points including in schools and the third sector so that children can access support when problems emerge?

    Much work also needs be done to ensure that every child and young person gets the support that they need for their mental health and wellbeing. We need to step up as a society and be more ambitious in our call for better support for children and young people’s mental health. More funding and resources will be an investment in our children’s future. It is time for the Government to act and listen to the voices of children and young people, especially those suffering from trauma. If we do not act now, when will we?

    The speech made by Marsha De Cordova, the Labour MP for Battersea, in the House of Commons on 23 May 2022.

    It is a pleasure to follow my hon. Friend the Member for Stockton North (Alex Cunningham) and to speak in this Second Reading debate. The provisions in this Bill pose a significant risk to the UK’s adherence to its domestic and international human rights obligations, and the Bill is unlikely to be compliant with the European convention on human rights, particularly article 10 on freedom of expression and article 11 on freedom of assembly and association.

    Equivalent measures to the protest-banning orders were previously roundly rejected by the police and Her Majesty’s inspectorate of constabulary and fire and rescue services on the basis that such measures would neither be compatible with human rights legislation nor create an effective deterrent. Many organisations, including Justice, have said that the Bill would give the police carte blanche to target protestors. Similar laws can be found in Russia and Belarus. Is this the country we have become?

    That is why I support the amendment in the name of my right hon. and learned Friend the Leader of the Opposition. It is disturbing that the Government have put forward this Bill as their first piece of legislation in the Queen’s Speech, and when the ink is not even dry on their Police, Crime, Sentencing and Courts Act 2022. We have not even been able to assess that Act’s impact on people and communities. It beggars belief that the Government have brought forward this Bill during a cost of living emergency, when they should be focusing on tackling the crisis facing so many of our constituents. Moreover, the Bill’s provisions are more egregious than those in the Government’s amendments to the Police, Crime, Sentencing and Courts Act 2022 that were flatly and rightly rejected in the other place.

    My speech will focus on the Bill’s equality impacts, especially in relation to protest. Before entering this House, I spent most of my life as an advocate and campaigner, and I know from first-hand experience the power that protest can have. My freedoms today are directly linked to the organising and protests that happened on our streets, from the suffragettes who chained themselves to Parliament to secure votes for women, to disabled people who locked their wheelchairs to traffic lights to fight the discriminatory cuts to social security, and the Black Lives Matter protests.

    Protesting is one of the most effective ways for people from underserved and under-represented groups to organise and deliver change for our communities. Such people often do not have access to the seats of powers. They face significant barriers to democratic and civic participation. Clamping down on protest will not only have an impact on the types of issues that our communities will be able to voice their concerns about but shut down key avenues of mobilising the public to support and preserve our rights.

    I urge Government Members, and the Policing Minister in particular, to watch “Then Barbara Met Alan”, which highlights the fight for civil rights for disabled people and the role that protests played in securing the imperfect Disability Discrimination Act 2005. But for those protests and disabled people protesting and making sacrifices, many of the rights that we fight to maintain today would not have been secured.

    This Bill will criminalise protest tactics and drag people into the criminal justice system, and we know that people from our communities will suffer the most. Our communities are already over-policed and targeted by the authorities. I am especially worried about the provision on protest-specific stop-and-search powers. Those powers are a form of structural oppression that will continue to hurt and harm our black, Asian and ethnic minority communities. Their expansion will only entrench racial disproportionality in the criminal justice system and further erode trust in public institutions.

    Last week, the Home Secretary announced that she was lifting restrictions placed on police stop-and-search powers in areas where police anticipate violent crimes by easing conditions on the use of section 60 orders under the Criminal Justice and Public Order Act 1994. The Bill will amend section 1 of the Police and Criminal Evidence Act 1984 to expand the types of offences that allow a police officer to stop and search a person or a vehicle. It will also extend suspicionless stop-and-search powers to the protest context; police officers will be able to stop and search a person or a vehicle without suspicion if they reasonably believe that certain protest-related offences will be committed in that area.

    Despite ongoing revelations regarding the misuse and racist application of stop-and-search powers, the Government decided to roll them out further. I therefore hope that when the Minister sums up, he will address disproportionality. I am sorry, but the equality impact assessment is flawed. It does not address the Bill’s disproportionate impact on our black and ethnic minority communities, and on black men in particular. Overwhelming evidence, including the Home Office’s own data, provided to human rights and civil liberty organisations, details the inherent disproportionality in the use of police stop and search. We know from the Independent Office for Police Conduct’s report that, in the year to March 2021, black people were seven times more likely to be stopped and searched than white people; Asian people were 2.5 times more likely to be stopped and searched.

    We know that stop and search powers are ineffective. According to the Home Affairs Committee, between March and May 2020, more than 80% of the 21,950 stop and searches resulted in no further action. That is counterproductive. The decision to ease section 60 and the new powers in the Bill do not consider the trauma that structural oppression causes to our black and ethnic minority communities, and in particular to our black boys.

    The Bill will also create the offence of intentional obstruction of a suspicionless, protest-specific stop and search. It might be used to target legal observers, or community-led protest marshals, who play a vital role in protecting the rights of groups by keeping them safe and explaining many complicated and technical laws. They are there in an observer or advisory capacity. The lack of that crucial function will impact many groups, and disabled people and people from ethnic minority backgrounds in particular.

    We do not need the Bill. It will not solve the problems that it seeks to address. All it will do is increase the criminalisation of people from our under-represented and under-served communities. The Government are not interested in protecting people or serving those who need them most; they want only to protect themselves, to hold on to power by playing with people’s lives, and to manipulate the public to deflect from their failures. They are doing that at people’s expense. If they cared, they would have brought forward the victims’ Bill and ensured justice for the 1.3 million victims who gave up on the justice system last year. I will stand up for the people and, along with Opposition colleagues, I will vote against the Bill.

    This injustice cannot continue. The Windrush Compensation Scheme must be placed under independent leadership away from the Home Office so that people can finally receive the compensation they deserve.

    The Windrush scandal was an example of racial injustice, which is still experienced by many Black Caribbean people across British society.

    That is why the next Labour government will introduce a Race Equality Act, to systematically tackle structural and institutional racism.

    On the anniversary of Labour’s Equal Pay Act, we are calling for action to stop a two-tier recovery from the pandemic.

    Labour want to see data on the number of jobs created, the impact of the pandemic on the gender and ethnicity pay gaps and, an urgent review of the failing Shared Parental Leave system.

    Making it illegal to make a new mother redundant during pregnancy and maternity leave, except in very specific circumstances, is a simple robust way to end discrimination.
