    The speech made by Caroline Nokes, the Conservative MP for Romsey and Southampton North, in the House of Commons on 9 September 2020.

    Thank you, Madam Deputy Speaker, and that might mean some of the niceties go out of the window.

    My right hon. Friend the Chief Secretary is absolutely right to have identified the great long list of support that has gone to business, and I thank him for doing so because I now do not have to. I welcome the presence on the Front Bench of my hon. Friend the Economic Secretary to the Treasury. I would like to pay particular tribute to him for the help he has given me with individual constituency cases, particularly, I note, with one small business and Lloyds Banking Group. The hon. and learned Member for Edinburgh South West (Joanna Cherry) has just left—in time for me to make that point.

    I want to put on record some local perspective of where businesses in Romsey and Southampton North have had assistance: over 10,000 jobs protected by the furlough scheme; £9.5 million to self-employed people; more than £42 million of bounce back loans; and £17.5 million in business grants. Those are very significant figures. The borough council has worked hand in hand with the Government in reaching out to small businesses, making sure all those who are eligible applied and received assistance. Some 47,000 meals have been eaten via eat out to help out. Could my right hon. Friend the Chief Secretary pass on to the Chancellor the particular thanks of the lady I met in the Cromwell Arms in Romsey who wanted to talk about the “lovely local lad” who is of course my right hon. Friend the Chancellor?

    Turning to the issue of ongoing support for local businesses, I was pleased to hear this week from Simon Parkes of Elumin8, a Romsey-based business making advanced lighting systems for the automotive industry. He is looking to recruit between three and five new employees—young employees—as soon as possible, and is keen to make the kickstart scheme work not just for his business, but for the benefit of such unemployed young people. Both he and the local council are working with the local enterprise partnership to bring together the minimum number of 30 needed so that more local businesses will be able to benefit. It is great to see the determination to make schemes work and get young people into real jobs who will then enable his business, even in difficult economic times, to thrive and grow.

    I commend the support that has gone to hospitality. We know it is a sector that employs many young people and, indeed, many women—an interest I have particularly. I pay tribute to the Four Horseshoes in Nursling, which is continuing the scheme on its own terms, and I know across the country many are doing the same. However, it would be remiss of me not to return to a sector that I have raised many times in this House and will continue to champion. The beauty industry employs over 370,000 people, over 90% of whom are women. They have stayed locked down longer than other industries, and in some parts of the country they remain locked down, so I welcome the grants that my right hon. Friend has mentioned.

    The green homes scheme is a great scheme and one that can provide energy efficiency and jobs, but please can we make it as wide as possible, so that companies ​such as Kelda Technology in my constituency, which makes showers, can also benefit from it, reducing energy costs through reducing water heating costs?

    Finally, on those in the events industry, my right hon Friend the Chancellor is working really hard to rebalance the economy, but these are small businesses which, if allowed to thrive, will in turn be paying tax in years to come, enabling us to rebalance the economy.

    It feels like groundhog day. This debate has been scheduled, I believe, perhaps as many as four times, but events repeatedly knocked it off course. Today, however, we are finally back in the Chamber physically with a full day of debate, and I have the chance to finally bring to the Floor of the House the long and tortuous case of a single parking ticket.

    My hon. Friend the Minister need not look panicked that I am expecting him to do something about a specific parking ticket—the matter is now resolved—but I wish to draw to his attention the fact that my constituent, Mr Guy Hindle, was bullied by a succession of organisations over a period of some 20-plus months over a six-minute transgression. As Mr Hindle happily agrees, this is not about his experience. He is a resilient individual—very much so—and he eventually negotiated a payment of just £15, when at one point £247.62 was being demanded from him. It is about shining a light on what he refers to as the sharp practices of the wild west of parking services. It is not just my constituent who refers to private parking as the wild west. He is in great company. I tracked down some commentary from my hon. Friend the Chancellor of the Exchequer when he was a Minister at the Ministry of Housing, Communities and Local Government; he referred to it—private parking, not the Department—as the wild west, too.

    This case is a litany of bad behaviour. My constituent parked for a mere six minutes outside Vets for Pets in Southampton and did not see any signage regarding the charge for parking, so he was surprised to receive a penalty charge notice. He informed the company, Premier Park, that he intended to defend himself, preferably in court proceedings, because he regarded the £60 charge for a six-minute stop as unreasonable. He heard nothing more until June the following year—2019—by which time the matter had been passed to Premier Park’s legal representatives. Remember the original offence, if one can call it that, happened in March 2018. Then followed a succession of increasingly threatening letters mentioning county court judgments, and each letter and every telephone call my constituent made to Premier Park or their legal representatives made it clear that there would be many more letters—and so it proved. All along, my constituent was responding, “Take me to court. I have amassed a dossier of evidence. I am prepared to defend myself. I believe I have a good case.”

    Finally, in January this year, my constituent received confirmation that Premier Park would commence court proceedings unless my constituent was happy to agree to mediation. This was the first time that mediation had been mentioned. The original offence was in March 2018, and here he was, in January 2020, and suddenly the offer of mediation was made.

    I congratulate the right hon. Lady on bringing this case to the House. She is not the only one who has had run-ins with private car park firms. Indeed, the one she talks about ranks high in my mind. I fought a number of cases against it, and I have to say that ultimately I won them all. Does she ​agree that in the times we are facing, the privately run car park sector should show the same flexibility as our council car parks by removing charges and forestalling following through on any contraventions until we are past this very difficult time? Now is not the time for anyone or any private car park to profiteer or take advantage. We have to help our constituents and those individuals who have been held to be in the wrong for these contraventions.

    I will make two points in response to the hon. Gentleman. First, I have a most excellent staffer who for the last 10 years has described herself as my office expert on parking charges. She cringes somewhat when into the email inbox pops yet another case, but as I tell her, she has a 100% track record so far and we are very proud of her.

    On the points the hon. Gentleman made about private parking charges at the moment, I am conscious that in Test Valley borough, half of which I represent as the Member for Romsey and Southampton North, the borough council waived parking charges right at the beginning of the pandemic and has since extended the free parking period. There are some challenging questions ahead, because as we move forward post pandemic, we want to see our high streets recover and to assist that recovery. I think the Chancellor and the Department have come up with some amazing and really important packages, but I have no doubt that the income from parking that councils have forgone has been a huge cost to them. They will need to find ways to make up that loss, but my plea to them is to show a spirit of tolerance and support for the shopkeepers and to allow our high streets to recover gently from this difficult period. The immediate reimposition of parking charges as lockdown ends would be a retrograde step. I was delighted to see the Minister nodding during that intervention, in which a really important point was made.

    As my constituent said to me, had mediation been offered to him early in the proceedings, he would have taken it—it would have been the sensible thing to do. Instead, however, he kept responding to Premier Park, “No. I’ll see you in court.” The company kept responding, “We’ll take you to court,” or rather, “We’ll send you more letters threatening to take you to court. We’ll get increasingly aggressive. The charges will go up and up. We’ll employ a succession of different legal representatives until you don’t know which one you’re trying to deal with.” But two years on, the offer of mediation was made, my constituent accepted it and they settled on a sum of 15 quid, which I do not think is bad going.

    What worries my constituent and me is the repeated bullying tactics: the threats of legal action, which are then not followed up for many months—in this case 20 months—the alarming threat of county court judgments, which we know have a devastating impact on people’s credit rating, and the threatening assertion that there will be lots more letters like that one.

    I am conscious of the most excellent piece of legislation introduced by my right hon. Friend the Member for East Yorkshire (Sir Greg Knight), which came into force in March 2019 and paved the way for a single code of practice for private parking, giving drivers greater protection through a new appeals service. My right hon. Friend the Chancellor of the Exchequer, when he was at the Ministry for Housing, Communities and Local ​Government and occupying a similar portfolio to the Minister, championed the issue on behalf of the Government. This sort of code could have made my constituent’s life much less of a misery.

    More recently, back in November 2019 my right hon. Friend the Secretary of State for Housing, Communities and Local Government appointed the British Standards Institution to work with consumer groups and industry to write the first ever compulsory code of practice for private parking firms to

    “restore common sense to the way parking fines are handed out…crack down on dodgy operators”

    and

    “introduce a new independent appeals service”.

    I know that is correct, because I lifted it from the press release I found on gov.uk. The code was also to ensure that a mandatory 10-minute grace period, which already applies to local authority car parks, be extended to all private parking services.

    I take my hon. Friend the Minister back to the precise period my constituent parked for: six minutes, which is four minutes less than the minimum grace period suggested. I am prepared to concede that my constituent’s supposed six-minute transgression happened before the excellent private Member’s Bill and before the Secretary of State appointed the British Standards Institution to write the new compulsory code, so maybe it is not reasonable to expect a member of the British Parking Association to apply 2019 standards to a 2018 offence—notwithstanding the fact that it was Premier Park itself that dragged the whole matter out for 20 long months—except that the British Parking Association voluntary code of practice already referenced a 10-minute grace period.

    Returning to the crux of the matter, the previous Minister with this responsibility, my hon. Friend the Member for Thornbury and Yate (Luke Hall), in response to a written question indicated that the British Standards Institution was contracted in December 2019 to develop the new code. It was tasked with convening a group of key stakeholders to write it, and there was to be a full public consultation within six months. The final code would be developed this year.

    I do not wish to hassle the Minister and try to hurry the process along, and I absolutely acknowledge that covid has got in the way of many things, but this year is ticking by very quickly. My constituent and, indeed, those of other hon. and right hon. Members who have returned to this Chamber time and again to discuss private parking services need the code. I argue that the parking industry also needs it, and it is more than a year since the excellent private Member’s Bill of my right hon. Friend the Member for East Yorkshire.

    Will the Minister this evening in this much delayed debate therefore please give us an update on progress and an absolute commitment that, exactly as was said in February, the code will be developed this year and introduced? Will he reassure me and my constituent that the 10-minute grace period or transaction period, which allows a driver to enter a car park, establish the charges and then decide whether he wishes to pay them or whether they are far too high for his taste and he wishes to leave and go elsewhere, will be included? That could have saved my constituent 20 months of harassment and pain.​

    That grace period should be a crucial part of enabling drivers to make informed choices in future. That is what this is all about: allowing drivers to make informed choices and giving them a bit of leeway so that they can decide whether that is actually where they wish to park. I learned from my right hon. Friend the Member for East Yorkshire that there might be many good reasons why parking charges are not advertised outside a car park, such as it being in a conservation area where there might be restrictions on signage. We should give drivers the opportunity to go into a car park, have a look and then potentially leave.

    I conclude by asking the Minister to make that assurance, to give us an update on when this code is coming and when the public consultation will happen or whether it has already happened and to give us a sense of progress and a sense that this matter is in hand and will be dealt with.

    I have a great deal of support for the view of my right hon. Friend the Leader of the House that debates held in this place without intervention are sterile and that we are failing to scrutinise the Government adequately. However, as Chair of the Women and Equalities Committee, I have to endorse the comments of the shadow Leader of the House: these measures do not just look discriminatory—they are discriminatory.

    Instantly, a number of groups with protected characteristics are excluded. Those who are pregnant or new mothers, or older Members, might be advised not to come here via public transport. The underlying health conditions of either Members or their families are, to be frank, none of our business, but they will be excluded, as my right hon. Friend the Member for Harlow (Robert Halfon) has been. I appreciate the lengths to which Mr Speaker has gone to ensure that we have adequate arrangements for queuing, but how suitable are they for people with disabilities, including hidden disabilities?

    Covid has too often been described as a great leveller, in that anyone can catch it—we saw that from my right hon. Friend the Prime Minister—but its unequal impact is well documented. Older people, men, those from BAME backgrounds and those with underlying health conditions now have a very stark choice: stay at home and play no part in proceedings, losing your right to cast your vote on legislation, or come here and expose yourself and your family to greater risk.

    I absolutely accept that this House is not our employer, but good employers have a duty to make reasonable adjustments to ensure that workers with disabilities and health conditions are not substantially disadvantaged. By taking away the ability to vote remotely, we are substantially disadvantaging those people. I would argue that the amendments tabled by my right hon. Friend the Member for Staffordshire Moorlands (Karen Bradley) are, in fact, a reasonable adjustment, and for that reason I will be supporting them this afternoon.

    Below is the text of the speech made by Caroline Nokes, the Conservative MP for Romsey and Southampton North, in the House of Commons on 18 May 2020.

    It is a pleasure to be able to speak in this debate from a more nuanced perspective than I would have been permitted just 12 months ago. I welcome the hon. Member for Torfaen (Nick Thomas-Symonds) to his new role. The last time he and I debated immigration, it was in a debate on the previous iteration of this Bill, when he had the opportunity to intervene on me frequently—an opportunity denied to him today.

    The hon. Gentleman said that we are rushing the Bill but also pointed out that it is just two clauses different from the previous Bill, which we well debated. I argue that we are not rushing the Bill. It is something that we must complete before the end of the transition period on 31 December this year. He also commented on the use of statutory instrument to change the immigration rules. That has ever been the case and often can be used for good; I highlight the example of Afghan interpreters, on which I remind my right hon. Friend the Home Secretary there is still more to be done.

    Returning to the iteration of the Bill in front of us, there is no doubt that we must turn off free movement. We must uphold the outcome of the 2016 referendum, as my right hon. Friend the Home Secretary rightly pointed out, but I would argue that we must do that with caution, and a phased approach might give us more flexibility. This time last year, matters were very different. I was an immigration Minister seeking to find a route through a minefield at a time of record employment. I have grave fears that my right hon. Friend will find herself doing it at a time of record unemployment. Perhaps those roles that British workers have been able to choose not to do over the past 10 years will be more attractive than they were, but the omens do not look good.​

    We heard calls for a British land army that were repeated yesterday by Waitrose, and many thousands have responded, but few have chosen to pursue the option. One in six of the brave care workers on the frontline of the battle against coronavirus are non-UK nationals. I commend the Home Secretary on her commitment to extend visas to doctors and nurses, but what of care workers? Are they to be the Cinderella service, forgotten once again? What of ancillary staff in our hospitals, who are crucial in a war against the virus in which repeated deep cleaning is an absolute imperative. We cannot open hospitals if we cannot clean the loos.

    Many in the House have experience of the Home Office —I think that no fewer than six immigration Ministers since 2016 have had a hand in trying to introduce a Bill to end free movement—but it is a machine that moves slowly. Sometimes the best laid plans to revolutionise our immigration system do not work well when introduced in a big-bang style. That is in the best of times; we are not in the best of times. We know from Home Office press releases that there are backlogs in the settled status scheme; that visa application centres are closed; and if someone wishes to renew their indefinite leave to remain, or obtain a new biometric residence card they cannot do so currently. The Under-Secretary of State for the Home Department, my hon. Friend the Member for Torbay (Kevin Foster) responded to me on 16 March that the Home Office was planning an engagement programme for employers that would start that month, explaining that those who were not already tier 2 sponsors should consider “applying now”.

    Small businesses that have no experience of the visa system need to become registered sponsors by January, or they will not be able to sponsor the visas of new employees. That includes care homes—the people on the frontline of this crisis. I wonder whether that engagement programme, which was supposed to begin in March, did indeed do so, or has it understandably been delayed? We know from news emanating from the Home Office that it is very much not business as usual, so can care-home owners, freight transporters, retailers, food processors, au pairs and childcare providers have confidence that their applications will be processed, even if they know that they need to apply “now”—that is the Minister’s word, not mine?

    I hope that the Home Office has in place the resources needed to process the many thousands of applications to become sponsors that may be made by businesses that have never had any previous contact with the system whatsoever, but I would ask what bandwidth the care-home manager, frantically trying to put a ring round her home to keep residents and staff safe, has suddenly to think, “I had better apply to become a sponsor—just in case.” This is a crucial Bill, but I would like more than two words from the immigration Minister on how it can be delivered in a big-bang fashion in just seven months’ time, when history has proved that that is perhaps not the best way to deliver bold, new immigration systems.

    Below is the text of the speech made by Caroline Nokes, the Conservative MP for Romsey and Southampton North, in the House of Commons on 28 April 2020.

    It is a pleasure to be able to speak in this debate—arguably for the second time, having contributed back in October. What has been really interesting today is the quality of contributions from both returning and new Members. I pay tribute to my hon. Friend the Member for Hyndburn (Sara Britcliffe), who made a very powerful maiden speech, albeit in interesting circumstances. I reassure other Members that, although she sits on the Women and Equalities Committee that I now Chair, I have at no time found her to be remotely difficult.

    I thank the Lord Chancellor for his opening comments. I would like to pay tribute in particular to the Under-Secretary of State for the Home Department, my hon. Friend the Member for Louth and Horncastle (Victoria Atkins), the Minister with responsibility for safeguarding, who will close the debate this evening. She has proven to be a doughty champion of the Bill on the various occasions it has come back before us. She has also taken time, during the intervening months, to speak to various Members, including me, about the difficulties and challenges in bringing into legislation amendments or parts of the Bill that would tackle the cases that my hon. Friend the Member for Wyre Forest (Mark Garnier) highlighted so eloquently. I remember sitting behind him in October when he spoke of Natalie Connolly. What is tragic and sad about that case, although horrific and dreadful, is that it is not unique. We will see more individuals who are perpetrators of domestic violence trying to run that sort of defence. We have to find a way to stop that. I am certainly committed to working with my hon. Friend and the right hon. and learned Member for Camberwell and Peckham (Ms Harman) in that regard.

    We know that domestic abuse can affect anyone: both genders, people who are able-bodied and disabled, and all ethnicities. It is no respecter of socioeconomic background. What we do know is that it impacts some more than others. LGBTQ people are twice as likely as the rest of the population to suffer from domestic abuse. We heard earlier about the impact of domestic abuse on people with disabilities, perhaps particularly those with sight impairments. Those are all issues that have been raised with Members by various charities over the course of the past few days. We all know that it is no respecter of age. I urge Ministers to look again at how they can include in their statistics victims of domestic abuse who are over 74. We know that the National Crime Survey does not pick up on that. Tragically, over the course of the past few weeks we have seen more pensioners who have been impacted. That is absolutely horrific and we have to find ways to include that in the Bill. There is a great deal to be done in Committee. I urge all Members who have the opportunity to serve on the Bill Committee to ensure that the changes that some of us wish to see can be reflected in it.​
    We debate the Bill at the time of pandemic, when there is even more pressure on individuals, relationships and families. I wonder whether the Minister, in her closing comments, might reflect on the increase we have already seen in referrals to domestic abuse helplines, both online and telephone. When locked down with the perpetrator of domestic abuse, it is much harder for women to report those crimes. I ask her to reflect on what we might see when the pressure cooker valve is released and whether we will see yet more people reporting.

    I want to conclude by speaking about the issue I raised on Second Reading part one, which is that of migrant women. I vividly remember sitting with my hon. Friend the Under-Secretary of State and my hon. Friend the Member for Charnwood (Edward Argar), in his time as a Justice Minister, alongside Southall Black Sisters and other groups representing migrant women. We know that people will use finances and physical strength—they will use any means they can to control people. Sadly, they will also use immigration status and passports. They will seize their victim’s documentation and keep it from them so that they cannot assert their right to be in the UK legally. It is crucial, as all the Ministers in that meeting said, that we see people first as victims and not through the prism of their immigration status.

    My hon. Friend the Under-Secretary has a track record of standing up to those who seek to use power, influence and status to belittle and bully others. I reassure victims that they have a doughty champion in this Minister.

    Below is the text of the speech made by Caroline Nokes, the Conservative MP for Romsey and Southampton North, in the House of Commons on 23 March 2020.

    There have been some fantastic speeches this evening so far, including from my hon. Friend the Member for High Peak (Robert Largan) who made a stunning maiden speech, but I wish to go back to the words of my right hon. Friend the Secretary of State when he said that the virus impacts most the weak and vulnerable. He is of course right.

    I support the measures in the Bill. They are extraordinary measures that can only be used in extraordinary times, but that is exactly what we are facing. Tonight I wish to speak for the weak and the vulnerable, as hon. Members might expect from the Chair of the Women and Equalities Committee. I have real concerns about how equalities might be impacted and about how those people with protected characteristics for whom we speak might be affected. I draw particular attention to the elderly, who we know are the most impacted by this disease, and their need for care that is appropriate in their own homes at the right time. I speak for the disabled, who of course have the biggest challenges and who desperately need assistance. I appreciate why we have the powers in the Bill, but they must be used proportionately and reasonably.

    I also speak for those from black and minority ethnic backgrounds, and, of course, the Paymaster General, my right hon. Friend the Member for Portsmouth North (Penny Mordaunt), has done some phenomenal work with faith communities, making sure that funerals can be held appropriately for religions. But I would like to point out that it is in the gig economy where we are most likely to find people from a BAME background working: they are also most likely to be young people. They are also most likely to be self-employed, on zero hours or sole traders, and we must be particularly cognisant of the impact the virus will have on those people who we will want—when this horror is over—to be able to bounce back to be the entrepreneurs who will enable our economy to recover from this difficult period.

    I will also, of course, mention women. We know that caring responsibilities fall most heavily on their shoulders. We also know that in areas such as childminding, childminders are not only doing the caring, but of course are providing the support that enables women to go out to work, whether it be in our essential professions at the moment or in all parts of the economy. We must provide support to the childminding sector as well as the early years sector, because when the virus is quashed and we are in a position to rebuild the economy, we will need childminders to enable that 50% of the workforce to go back to work. We have done great work over the past few years in making sure that there are more women in employment, but we have to make sure that it is possible for them when this is over to be able to—

    That is exactly the point: so many of the early years sector and childminders are self-employed. That is another reason to repeat the point that so many have made today about why we need something for that part of the economy.

    My hon. Friend is right, so I have managed to fit in the childminding sector and the self-employed in one hit.

    I want also to speak about volunteering and the clarity that is needed. There is a great company in my constituency that runs Kimbridge Barn. That is shut, of course, but the company wants to enable its staff to volunteer, whether in the health service or the care sector, or as delivery drivers—it has many vehicles—but it wants clarity as to whether the 80% of salaries that HMRC will underwrite will be applicable if people are effectively outworking in a voluntary capacity.

    I also draw attention to the comments made by my right hon. Friend the Member for South West Surrey (Jeremy Hunt) about whether local government officers should be considering planning applications at the current time. I would also ask whether they should be implementing or imposing parking fines. Those are all areas of regulation that are undertaken by local authorities that are far from an imperative at the current time.

    I would like to pay tribute in the voluntary sector to both Southampton Voluntary Services and Unity in Test Valley, who have done some brilliant work pulling together volunteer bureaux and making sure that people in the shielded group will have the support from people in the community who can help deliver medicines and essential shopping.

    There is much in the Bill that in ordinary times we would not consider, but I end with one final plea about parliamentary scrutiny. There is as yet no mechanism or ability under Standing Orders for Select Committees such as the Women and Equalities Committee—which has much to scrutinise in the Bill—to meet remotely by video link, by Zoom, by Skype for Business or through any other mechanism. I understand that the Leader of the House will make a statement at some point. I very much hope that he will make sure that, at the very least, the Select Committee structures can work at this time to ensure that measures such as this are held to proper scrutiny, so that we understand how they are impacting on the most vulnerable.

    I congratulate the hon. Member for Newcastle upon Tyne Central (Chi Onwurah) on securing this debate. I welcome her passionate contribution and recognise the importance of this issue and the sensitivities around it. She described herself as a tech evangelist and she has brought a great deal of knowledge and experience to the House in this debate and with some of the wider issues that she has consistently raised in the House since she arrived in 2010. I hope that the House will forgive me if I spend a bit of time focusing on the wider visa and immigration system before moving on to the specific points that the hon. Lady made, because she raised some wider concerns about the Home Office and the borders and immigration system.

    We welcome people from all over the world to visit, study, work and settle here. We welcome their contribution and the fact that Britain is one of the best countries in the world to come and live in. That is why we operate a fair system, under which people can come here, are welcomed and can contribute to this country. However, we need a controlled system: because this is one of the best countries in the world to live in, many people wish to come here. A controlled system, where the rules that make that possible are followed, is what the Government are building and that is certainly what the public expect.

    At the end of 2018, we published a White Paper on the future borders and immigration system, which will focus on high skills, welcoming talented and hard-working individuals who will support the UK’s dynamic economy, enabling employers to compete on the world stage. Following its publication, we have initiated an extensive programme of engagement across the UK, and with the EU and international partners, to capture views and ensure that we design a future system that works for the whole United Kingdom.

    Just last week, as part of that engagement and as part of London Tech Week, I enjoyed the opportunity to participate in a roundtable with members of Tech Nation, where I was joined by the Minister for Digital and the Creative Industries, my hon. Friend the Member for Stourbridge (Margot James). That occasion is always a great opportunity for Ministers to engage in cross-Government work, to understand the challenges that our future visa system may provoke, and to understand how those who are actually using the system have been finding it and what aspirations they may have for the future.

    When discussing the scale of our visa system, I always think it important to remind the House of just how large it is. Thousands of decisions are made every single day, the overwhelming majority of which are completed within published service standards and enable people to visit the UK, to study here, to work here, or to rebuild their lives here. In 2018, UK Visas and Immigration received more than 3.2 million visa applications, of which just under 2.9 million were granted. The service standard for processing a visit visa is 15 working days, and last year UKVI processed 97% within that target. As I have said, the UK welcomes genuine visitors, and more than 2.3 million visitor visas were granted for leisure, study or business visits—an increase of 8% in the past year.

    The scale of the work that UK Visas and Immigration undertakes means that it has always used processes that enable it to allocate cases in as streamlined, efficient, ​and rapid a manner as possible to deliver a world-class visa service. It allocates applications to caseworkers using a streaming tool that is regularly updated with a range of data. The tool is used only to allocate applications, not to decide them. Decision makers do not discriminate on the basis of age, gender, religion or race. The tool uses global and local historical data to indicate whether an application might require more or less scrutiny.

    As the hon. Lady explained so comprehensively, an algorithm is a series of instructions or a set of rules that are followed to complete a task. The streaming tool which is operated by UKVI decision-making centres is an algorithm, but I should make it clear that it is not coding, it is not programming, it is not anything that involves machine learning, and, crucially, it is not automated decision making. It is, effectively, an automated flowchart where an application is subject to a number of basic yes/no questions to determine whether it is considered likely to be straightforward or possibly more complex. As I said earlier, the streaming tool is used only to allocate applications, not to decide them.

    I thank the Minister for the remarks that she is making, and also for the way in which she is responding to my own remarks. She has said that the algorithm is used for allocation purposes. I understood that it was also used to assess risk. That is the “red, amber, green” traffic-light approach, which is about something slightly more than allocation.

    I am glad that the hon. Lady has made that point, because I was just about to deal with it.

    As I have said, a decision maker assesses every application against the immigration rules, on its individual merits, and taking into consideration the evidence provided by the applicant. The effective streaming of applications ensures that those requiring more detailed and closer scrutiny are routed to appropriately trained assessing staff. It is essential in delivering enhanced decision quality by developing robust decision-making structures, and—as the hon. Lady just mentioned—directing a risk-led approach to decision manager reviews. Streaming does not determine the decision; it determines only the process that is undertaken before a decision officer assesses the application and the requirements for decision manager assurance.

    Since 2015, UKVI has developed a streaming tool that assesses the required level of scrutiny attached to an application. It is regularly updated with data relating to known immigration abuses, and with locally relevant data. It is also used to prioritise work—for example, when the applicant has paid a priority fee for faster processing.

    Streaming indicators can be positive as well as negative, and might include a previous history of travel to the UK and other Five Eyes or EU countries, or previous compliance with immigration rules. The streaming might indicate potential safeguarding concerns. It could also be used to indicate criminal records and of course a sponsor with a very good record of associated compliance. Use of the streaming tool creates a globally consistent approach and supports an objective data-driven approach to the consideration of an application. For every application regardless of its stream, an entry clearance officer must carry out a range of decision-making functions before ​arriving at a decision, most notably an assessment of whether an application meets the requirements of the relevant immigration rules.

    The hon. Lady referred to the Independent Chief Inspector of Borders and Immigration. In 2017 his report on the entry clearance processing operations in Croydon and Istanbul raised no concerns that applications would be refused because of streaming and contained figures that indicated that over 51% of applications streamed as requiring further scrutiny were issued.

    The hon. Lady referred to her significant and important work with the all-party group on Africa, and as she said I was very pleased to meet the group earlier this year. She will know that over 47,000 more visas were issued to African nationals in 2018 than in 2016, an increase of 14%. The percentage of African nationals who saw their application granted is up by 4% on 10 years ago and is only slightly below the average rate of the past 10 years of all nationalities. Visa applications from African nationals are at their highest level since 2013. The average issue rate for non-settlement visa applications submitted in the Africa region is consistent with the average issue rate for the past three years, which has been 75%.

    The UKVI Africa region is responsible for the delivery of visa services across sub-Saharan Africa. The region currently processes in excess of 350,000 visa applications per year. On average—and in line with other regions—97% of non-settlement visa applications submitted in the Africa region are processed within the 15-day service standard.

    There are 31 modern visa application centres in the Africa region, 28 of which offer a range of added-value services and premium products to enhance the customer experience and/or speed of processing. I had the privilege of visiting one of our visa application centres in Africa last year when I visited Nigeria and met a wide range of students who were coming to the UK to study.

    The hon. Lady mentioned visas for performers at festivals. I am delighted to see the hon. Member for Edinburgh North and Leith (Deidre Brock) in her place, because I recently had a meeting with her and the Edinburgh festivals organisers. We had what I thought was a very constructive dialogue about problems that international artists may have previously experienced and how to ensure that there are improvements going forward. We are also working closely with the Department for Digital, Culture, Media and Sport to understand the requirements of the creative sector and, as part of the introduction of the future borders and immigration system, which will be phased in from January 2021, we are engaging widely across many sectors and all parts of the UK to work out how we can improve our system.

    The hon. Lady asked a wide range of questions, some of which—such as those on the regulation of algorithms and the tech sector—are perhaps not best addressed by the Home Office. I was somewhat sad to have seen the Cabinet Office Minister my hon. Friend the Member for Torbay (Kevin Foster) leave his place. I spent a happy six months at the Cabinet Office as Minister with responsibility for a wide range of matters, including the Government Digital Service. In that role I did not perhaps come to the Chamber to discuss things very much, but the hon. Lady has made an important point about the design of algorithms and the painfully high prevalence of young white men in the sector. We all understand, particularly in terms of artificial intelligence ​and machine-led learning, that bias can certainly exist—I was going to say creep in, but I fear that is in no way explicit enough. Bias can exist when a narrow demographic is designing algorithms and machine-led learning. We must all be vigilant on that.

    I am not going to stand at the Dispatch Box and promise regulation from the Home Office, because that would be inappropriate, but the hon. Lady has made some important points which must be taken up by the Cabinet Office and DDCMS to make sure that we have regulation that is effective and in the right place.

  • Caroline Nokes – 2019 Statement on the EU’s European Travel Information Authorisation System

    Below is the text of the statement made by Caroline Nokes, the Minister for Immigration, in the House of Commons on 24 April 2019.

    The Government have decided to opt in to the aspect of the draft regulation that establishes the conditions for the access of the European travel information authorisation system (ETIAS) to the European criminal records information system (ECRIS-TCN), and has decided not to opt out of the aspect of the draft regulation that establishes the conditions for the access of ETIAS to the second Schengen information system (SIS II).

    ETIAS is the EU’s travel authorisation system that visa-exempt visitors (third country nationals and stateless persons) will have to apply to prior to their entry in the Schengen area. The UK does not participate in ETIAS as it forms part of Schengen border legislation that the UK cannot participate in, but the UK fully supports the EU’s efforts to strengthen its external borders of which this forms part.

    Under this proposal, an ETIAS central unit will access EU information technology systems to support their considerations, specifically ECRIS-TCN and SIS II. Once implemented, the regulation will allow the EU to revoke a grant of admission to a third country national if a relevant alert is identified from data the UK has uploaded to the ECRIS-TCN or SIS II databases. The European Commission has been working towards 2021 as the date from which ETIAS would become operational, but the date might be extended to 2023.

    Whilst there are advantages to the EU from ETIAS having access to UK’s data, there are no obvious operational or public protection benefits for the UK given it involves the provision of data to a scheme that the UK does not participate in. However, a significant argument in favour of participating is to prevent the UK’s non-participation from giving rise to issues around UK access to SIS II or ECRIS-TCN in future.

    Until the UK leaves the EU we remain a full member, and the Government will continue to consider the application of the UK’s opt-in to EU legislation on a case by case basis, with a view to maximising the UK’s efforts to collaborate with the EU on a security partnership once the UK leaves the EU, including on SIS II and ECRIS-TCN.

  • Caroline Nokes – 2019 Statement on EU Settlement Scheme Emails

    Below is the text of the statement made by Caroline Nokes, the Minister for Immigration, in the House of Commons on 11 April 2019.

    The EU settlement scheme is an integral part of protecting the rights of EU citizens who have made their homes here in the UK, giving them an easy way of demonstrating their status in this country so that in years to come we do not find ourselves in a position where people have issues making clear the rights that they have. The scheme, which is free of charge, is performing well and over 400,000 EU citizens have already applied, with over 50,000 applications received on the opening weekend.

    The Home Office receives a large number of enquiries in relation to the scheme. When responding to generic enquiries, responses are sent in batches. The process for this is such that recipients would not normally be able to see the other email addresses. Regrettably, it has come to my attention that on Sunday 7 April three emails were sent that did not follow the appropriate procedure and 240 email addresses were made visible to other recipients. No other personal data was included in the communication.

    We have written to all individuals who received this email to apologise. The departmental data protection officer has been informed and the Department has voluntarily notified the Information Commissioner’s Office of the incident. An internal review is also underway to determine the details of what happened and the lessons that need to be learned.

    The Home Office takes its data protection responsibilities very seriously and is committed to the continued improvement of its performance against the UK’s high data protection standards. As a Department we have been taking steps to ensure we have the culture, processes and systems in place to treat the public’s personal data appropriately.

    As a further immediate step we have put in place strict controls on the use of bulk emails when communicating with members of the public to ensure this does not happen again as lessons are learned. An independent review of the Department’s compliance with its data protection obligations has also been commissioned which will be led by non-executive director Sue Langley and will report in due course.

  • Caroline Nokes – 2019 Statement on the Windrush Compensation Scheme

    Below is the text of the statement made by Caroline Nokes, the Minister for Immigration, in the House of Commons on 8 April 2019.

    Yesterday the Home Secretary announced the launch of the Windrush Compensation Scheme. The Government deeply regret what has happened to some members of the Windrush generation and the launch of the compensation scheme marks a key milestone in righting the wrongs they have experienced.

Those calling from outside the UK will be called back.

    I would like to clarify, further to questions raised with the Home Secretary on the Floor of the House, three issues in relation to eligibility to apply for compensation. The first is in relation to those who are not resident in the UK. A Commonwealth citizen outside the UK, who was settled in the UK before 1 January 1973, who has settled status, right of abode or is now a British citizen, or whose settled status has lapsed due to being absent from the UK for a period of two or more years is eligible to apply for compensation.

    Secondly, the definition of a close family member for the purpose of the compensation scheme is a spouse or civil partner living with the claimant, cohabitee for continuous period of two years or more, a parent, a child or a sibling. Close family members are entitled to ​claim regardless of whether a primary claimant chooses to make an application and whether said claimant is deceased.

    Thirdly, the definition of serious criminality for the purposes of the compensation scheme is defined as a conviction that received a sentence of imprisonment of four years or more, and that the offending was of such a nature that makes it inappropriate to make an award in whole or part. This provision does not apply to a conviction and sentence outside of the UK for conduct which on the date of the conviction was not an offence in the UK.

    The Home Office is committed to raising awareness of the scheme, and to encouraging eligible people of all nationalities to submit a claim. Eligibility for compensation goes beyond members of the Caribbean Commonwealth, and we are putting in place a programme of events with key stakeholders, faith and community organisations to promote both the scheme and the wider work of the Commonwealth citizens taskforce. The first of such events is scheduled for Lambeth town hall on Friday 5 April and full details are available via the gov.uk page.

    Regrettably, in promoting the scheme via email to interested parties, an administrative error was made which has meant data protection requirements have not been met, for which the Home Office apologises unreservedly.

    This occurred in emails sent to some of the individuals and organisations who had registered an interest in being kept informed about the launch of the compensation scheme, which included other recipients’ email addresses. Five batches of emails, each with 100 recipients, were affected. No other personal data was included.

    A recall was commenced as soon as the problem had been identified. The departmental data protection officer has been informed and an internal review will be conducted to ensure this cannot happen again. The Department has voluntarily notified the Information Commissioner’s Office of the incident.

    I am firmly committed to doing right by the Windrush generation. The compensation scheme is an important step towards that and I will ensure that action is taken to ensure the highest standards are met not only in the processing of cases, but also in continued efforts to publicise the scheme and ensure those entitled to redress receive it.
