    Alyn Smith – 2022 Speech on Ukraine

    The speech made by Alyn Smith, the SNP MP for Stirling, in the House of Commons on 22 September 2022.

    It is a pleasure to take part in this debate. I have been struck by the thoughtfulness and decency of several contributions from hon. Members on both sides of the House. I am proud of the SNP’s role in these discussions. I am proud that, despite our domestic priorities and political differences, we have been able to work with the Government. I commend the Minister for the Armed Forces and Veterans on his opening speech, and the Defence Ministers on their openness and the way that they have worked with both sides of the House. That is genuine on our part.

    Hon. Members can be damn sure that the SNP is part of the international coalition in defence of Ukraine: we believe in freedom, democracy and human rights and we believe that we should be good neighbours who should not live in fear of bigger powers. Of course, therefore, we are part of that and where we agree with the UK Government, we have agreed, as my good friend, my hon. Friend the Member for Glasgow South (Stewart Malcolm McDonald) said. On military support and sanctions, we have been vocal in our support of the UK Government’s position. We have often urged greater efforts than we have seen, but we have supported them.

    The only big difference between our position and that of the UK Government is on refugees. We would like to have seen the UK emulate the EU’s approach of waiving visas for three years. We think that would have been proportionate and fair. Instead, we saw a Home Office system that the Scottish Government have made work in Scotland. I pay tribute to the many big-hearted people across Stirling, Scotland and the UK who have opened not just their hearts, but their homes to the people of Ukraine who really needed support at that time. I was in Killin a few weeks back, and I was really struck by the care and affection that locals have had for the people who are guests in the community, and I do commend them on their effort.

    It is right today that we take due stock of events in Ukraine. As we have heard, the conflict is at a pivotal moment. Ukraine is winning and the Kremlin is losing. We take no pleasure in that fact, but there is a justice to it, in that aggression is not successful and there have not been the results the Kremlin was hoping for. President Putin’s statement overnight came from a position of weakness, as we have heard. His nuclear blackmail and his activation of the reservists, breaking a promise that he made, come from a position of weakness, not strength. We must be vigilant to the true risks that are presented by the Kremlin’s aggression not just against Ukraine, but against the liberal international order.

    We must also be steadfast in support of the Ukrainians themselves. We need to redouble our efforts. They are winning, but they have not won yet, and I fear there is an awful lot of heartache ahead for the Ukrainians before we see a resolution. So I was glad to hear from the Minister that military training and the supply of matériel and intelligence support will continue, and it does so with wholehearted SNP support. We may have points of difference and we will seek greater information on some points, but we do support that very strongly. I was also glad to hear that the eventual negotiated outcome—because there will be an eventual negotiated outcome; there always is to every conflict—is going to be on Ukrainian terms. A prerequisite for any talks, which as we have heard must be set from Kyiv, not from anywhere else, must be the withdrawal of all Russian occupying forces from all sovereign Ukrainian territory, including of course Crimea.

    I say that the conflict is far from over, but I would suggest to the Government a few points that we need to continue and take forward, because we cannot take our foot off the pedal. We have heard mentioned already the Ukraine fatigue among the general population and among the media, and we must make sure that we are not succumbing to it as well. Ukraine continues to need our support.

    We need to keep sanctions under review. I will be taking part for the SNP in the next debate, when we will revisit sanctions. We do need to keep them under review, to make sure that loopholes are closed because loopholes are being exploited, and we do need to make sure that any opportunity to raise pressure on the kleptocrats is taken. That is an evolving situation.

    We also need to be honest about and to guard against the influence of dirty money at home now. The UK is vulnerable to this, and we have seen a belated start on this from the UK Government, with our support, but we need to see much more. Our financial and property systems are nowhere near as transparent as they need to be, and they are vulnerable to dirty money. The overseas territories are playing a role that needs greater scrutiny than they have had, and we need to continue those efforts. We have seen a belated start to that, but we need to see more.

    On looking after refugees here, I have mentioned that people have opened not just their hearts, but their homes, and they need more support. We have seen a paper chase of a system that I do not believe is fit for purpose, but people have now largely negotiated through it. However, where we have seen too much paper chase, we are now seeing too little money. We strongly support—and we would really urge the Government to take this forward—doubling the monthly payment to £700 a month, because energy costs and the increased costs of having guests are hurting people, and that needs to be taken care of.

    To pick up the comments from my right hon. Friend the Member for Chingford and Woodford Green (Sir Iain Duncan Smith), there is a cost to this for people in the UK. He was right that we have to be honest about that, and I think the hon. Member is also making that point. However, we also need to reinforce the point that there is a bigger cost to our constituents if we do nothing. Does he agree with me on that point, and that we really need to ensure that people see we are doing this for a much greater reason? All the points he is making about refugees are absolutely right, but we are trying to prevent something much wider and much more destructive.

    Order. That was quite a long intervention and there is a time limit, so such interventions do prevent other people from having their allocation. If interventions are taken, it would be good if Members could still stick to their five minutes.

    I thought it was an excellent intervention personally. I agree with it strongly, so I am very grateful for it. We do need to make the case on an ongoing basis for the support we are giving those in Ukraine, because it is not just their freedom, but ours. The hon. Gentleman makes an important point.

    We do need to see more accountability. I pay tribute to the UK for the support that it has given to the International Criminal Court and the Canadian co-ordination of these efforts, but we need to make war criminals and potential war criminals aware that there will be no amnesty and no hiding place. The UK can do more about that—the UK has a developed legal system and a number of practitioners who are very active in this field—so we need to put more resources into it. The SNP is part of this coalition. I am proud that we have been able to work together on this point, because this transcends boundaries and transcends politics, and that support will continue.

    It is a privilege to sum up for the SNP in this debate. I warmly praise the hon. Member for Bolton South East (Yasmin Qureshi) for her powerful and moving speech and I extend my condolences to her. This is an important thing for us to take account of today. I am also glad to see the hon. Member for Rutland and Melton (Alicia Kearns) in her place and I commend her for her deeply powerful speech. She organised a trip to Bosnia for a number of colleagues across the House a few weeks ago and I was glad to be part of it. We visited Tuzla, Sarajevo and Srebrenica, and it was a deeply moving experience. I suspect I will remember the smell of the Tuzla morgue forever. I pay tribute to the work that it does in reconciling the human remains with the still grieving relatives. The truth and reconciliation process is still necessary across Bosnia; it is ongoing and it needs wider support. I was also glad to briefly see the right hon. Member for Beckenham (Bob Stewart) in his place today. He was on that trip, and he has a deep connection to Bosnia, having served there during the dreadful situation. It was a privilege to spend time with him and hear his stories of the events.

    All of us across the House can unite around the fact that genocide denial is an act of aggression. I pay tribute to Remembering Srebrenica, an important charity that does leading work not only to ensure remembrance but to challenge and remind us that the world has not learned the lessons of Srebrenica and other genocides. Sadly, I see the ingredients of what brought us to the dreadful events at Srebrenica present in other places around the world: Syria, Ukraine, Xinjiang, Yemen and other places besides. It is easy for us to say that we need to remember and learn the lessons, but the challenge to all of us in this House is: what are we going to do to prevent other genocides from occurring?

    As we see a more unstable world, with resource scarcity, climate instability and all sorts of other pressures, I regret to say that we are going to see more pressure on decency, democracy and international law. We can unite around the need for action, and I extend a hand to the Minister of State, Foreign, Commonwealth and Development Office, the hon. Member for Beverley and Holderness (Graham Stuart), whom I welcome to his place, to work together on this. There is a variety of world views and perspectives across the House, but surely we can all agree that more needs to be done to protect civilians, to protect and uphold international law and to protect decency.

    I have some concrete questions for the Minister. The peace in Bosnia remains fragile and I would be grateful for an update on just how the UK is supporting the institutions of Bosnia to make sure that peace is maintained. It is under pressure from external forces and also from internal forces that remain dangerous. I have called long since for the adoption by the UK Government of a specific atrocity prevention strategy. There is good work going on, and I pay tribute to that, but crystalising that into a unified document and a unified policy to work across the embassy network would be beneficial for all of us, and for the UK efforts as well.

    When I was elected, I fought for the creation of a genocide prevention centre, and the Government did indeed create it, although they called it the conflict centre. Does the hon. Gentleman not agree that the conflict centre would be ideally placed to do this work? It is a place of excellence and expertise that could identify very early the markers of a genocide and have experts who could deploy to the FCDO team to advise on the programmes, the social and community group interventions and the sanctions that would work to prevent genocide. Does he agree that that would be the best way to ensure that atrocity prevention was at the heart of the Government’s efforts?

    I am grateful to the hon. Lady for that intervention and I warmly agree. There is no shortage of good ideas around and I appeal to the Government and the Minister to take advantage of them, and of the opportunity for cross-party working across the House right now on this sort of issue.

    I acknowledge that the UK has done much on ensuring accountability. We discussed this just yesterday in the case of Sri Lanka. We are seeing it in China as well. We are seeing it particularly in Ukraine. I acknowledge that the UK has done work to support the International Criminal Court and the special prosecutor on Ukraine, but again, crystalising that into a specific strategy would be helpful for all of us in punching up the efforts to increase prominence and clarity across the world.

    In closing, I want to make a plea for Remembering Srebrenica and its funding. It does incredibly important work not just for Srebrenica and Bosnia but for these issues as a whole, and it needs a much more certain financial future than it has had, because it has had funding issues. So I hope that an update will be forthcoming from the Minister on ensuring that Remembering Srebrenica is safe to do its work to help all of us in the efforts we want to unite around. It has been a privilege to sum up in this debate.

    I warmly congratulate the hon. Member for Totnes (Anthony Mangnall) on securing this urgent question on a very difficult but very important subject. It is vital that we take due note of what is going on in Ukraine. We can all agree that rape as a weapon of war is beyond despicable. I will focus my remarks on urging the Government to take action on only three points, because much has been said that I agree with.

    SNP Members have called for a specific atrocity prevention strategy. Work is under way across the FCDO on these issues, but we think that bringing that into a coherent atrocity prevention strategy would be helpful in not only holding the Government to account on what is being done, but urging more action on that.

    On accountability, I agree with the Government’s approach of supporting the ICC, rather than creating new structures. That is proportionate and the best way to do it. I was glad to hear about the funding, but as we have seen from Syria, we can have all the evidence that we like, but if there is not the political will to carry it through, we will not see the necessary accountability on the ground and the fear of justice to end the culture of impunity that we are hearing reports of from Ukraine. I urge the Government to do more on that and to publish as one document the efforts that are being made to help accountability mechanisms in Ukraine, because that would again help the coherence and strategy to be clear to us all.

    I echo the points about people trafficking and safeguarding, on which I know the Minister has been very active. However, perhaps we can have a specific statement on the risk of trafficking of vulnerable refugees and what the UK and other partners have done to help and assist. I am aware that the German police have been doing very useful work on that, but, sadly, a lot more work needs to be done.

    I am grateful for sight of the statement. The SNP is part of the global coalition in defence of Ukraine in international law. I commend the Foreign Secretary and her Ministers on the openness with which they have dealt with Opposition Members. That trust will be reciprocated; this is too serious a time.

    If anything, I urge more. I support the statement and we will support the sanctions measures as they come forward, but I urge more and I urge faster ambition, particularly on refugees. The UK needs to waive visas, not wave flags. The EU has really given the lie to the generosity of the UK’s response on refugees by waiving visas for three years for all Ukrainian nationals. The UK needs to do the same. I appreciate that it is not in the Secretary of State’s remit, but I really urge the Government to act on the issue, because it is certainly the one most raised with me.

    The EU’s response through the civil protection mechanism and the peace facility dwarfs the UK’s. The EU has acted with one voice: 27 member states are acting together. I really urge the UK to complement those efforts and match their scale and ambition in its measures, which we support but wish to see more of.

    I have some specific questions about sanctions. We all agree about tackling oligarchs, but what plans are there to tackle and target the family members of oligarchs? When we were in Kyiv recently, that was mentioned as a particularly effective way of putting on pressure. I also note that there will be an advice facility for UK businesses affected by the sanctions. Is any consideration being given to providing financial aid for UK businesses hit by the sanctions? That seems the morally correct thing to do.

    The Foreign Secretary will be aware of reports of a Russian tanker heading for Orkney to pick up oil. Will the legal powers to impound such vessels be in place in time for us to do so?

    I too am grateful for advance sight of the statement.

    The impression we have been given of ministerial communications with Members of this House on constituency cases is not as rosy as has been put forward by Ministers. I constructively suggest that there needs to be a proper review of how adequate things actually were, because our experience is that communications were not as good as we have been told.

    I am glad to see that the new resettlement scheme is now moving, but I would like to unpack what 20,000 people over the coming years actually means. It is a good line, but I fear it will not stand analysis. Does it mean that the scheme will close if 20,000 Afghans apply and are processed in the first few months of next year? In that case the scheme is wholly inadequate. Or does it mean there is an annual quota? How long do the UK Government think vulnerable Afghans should wait while the Taliban hunt them down? In that case the scheme is similarly inadequate. We would like to see the scheme expanded and we would like much more clarity, which I understand is coming for the devolved Administrations and local government, particularly on how family reunion will be counted within those numbers—that is a crucial point for Afghans who are already here and those who are concerned.

    On the Foreign Secretary’s line about safe and legal routes to this country, in the name of policy coherence surely now is the time for the UK Government to pause the Nationality and Borders Bill because it would penalise many Afghans arriving by other routes. Afghanistan is in chaos, and they will not be able to form an orderly queue in the way one might like. Surely, in the name of policy coherence, one part of the UK Government should not be penalising Afghans arriving here while another part of the UK Government is trying to save them and keep them safe.

    Below is the text of the article by Alyn Smith, the SNP MP for Stirling, on 5 July 2020.

    Hong Kong has long been a special place. Its unique constitutional set-up – known as ‘one country, two systems’ – recognises that Hong Kong is a Special Administrative Region of China, but still allows it to retain its own legal and legislative systems, as well as enjoy a high degree of freedom.

    This week that principle was torn up by the imposition of the new National Security Law on the people of Hong Kong by the Chinese Government.

    While the details of the law were kept secret until it was passed, we know now that it has created several vague new criminal offences, including ‘subversion’ and ‘collusion with external forces’, which are punishable with a maximum sentence of life in prison.

    This law puts an end to freedom of speech, freedom of assembly and freedom of expression. It puts an end to the free society that we have watched Hong Kongers take in their hundreds of thousands to the streets to defend.

    The ‘one country, two systems’ principle was enshrined in the Sino-British Joint Declaration in 1984, when the UK committed – along with China – to protect Hong Kong’s unique status for the next fifty years.

    For this system to be dismantled before our eyes like this is more than a challenge to the international rules-based order: it is a direct challenge to the UK Government, and no amount of shiny new planes or Royal Yachts can disguise the fact that this is a humiliating affront to the United Kingdom on the international stage.

    These recent actions by the Chinese state are just the latest in a long pattern of aggression, disregard for human rights and disrespect for international agreements. They are a direct assault on our values and our interests and cannot be tolerated.

    The imposition of this law matters to us all.

    It matters to us as defenders of human rights that people everywhere are allowed to live freely and without fear, and that international human rights organisations like Amnesty International are able to carry out their vital work without fear of reprisal.

    It matters to us as internationalists that we can speak openly with people in other countries, and that the brave Hong Kongers I have spoken with in recent weeks can continue to share their stories without the threat of life in prison just for speaking to a foreign politician.

    It matters to us that as campaigners for an independent Scotland that international law is respected and strengthened, and that small states the world over know that the world order is based on mutually agreed rules, not mere economic and military might.

    This law matters to Scotland and it matters to the world.

    Time and time again, the SNP has made the case for safe and legal routes to this country for those fleeing political oppression and I welcome that – in this instance – the UK Government has listened and created a new path to citizenship for BNO passport holders. But we have to do more than that.

    When the people of West Berlin were threatened by the USSR, the international community they recognised that it wasn’t enough to simply open the door to those who were fleeing repression: they had to face the threat head-on. While Hong Kong may be a little further away than Berlin, the values that we share are universal.

    The UK Government must take a stand against China, if their much-touted idea of ‘Global Britain’ is to mean anything.

    They must join with our allies in the European Union and commit to lodging an action against China in the International Court of Justice to hold it to account for its breach of international law, they must open active consideration of targeted sanctions against China and Chinese companies active within the UK and – most fundamentally – the UK Government must show that breaking the law has consequences.

    I believe that China’s violations of international agreements and of the rights of its own citizens matters to us all. It’s about time the UK Government showed that it thinks so too.
